Regulations on the Management of the Public Security Video Imaging Information System

(Draft for solicitation of comments)

Article 1: [Legislative Purpose]These Regulations have been enacted so as to regulate the construction, use and management of public security video imaging information systems, to maintain public security, to safeguard the lawful rights and interests of citizens, legal persons and other organizations and to raise the standards of public service.

Article 2: [concept definition]"Public security video imaging information systems" (公共安全视频图像信息系统) as referred to in these regulations means systems engaging in the collection, transmission, display, storage and management of video image information with respect to areas or locations involving public security, by means of equipment for gathering video images or other related equipment, for the purpose of maintaining public security.

Article 3: [adjustment range]These Regulations apply to the construction, usage and management of public security video imaging information systems.

Article 4: [competent authorities]The Ministry of Public Security is responsible for supervision and management work for the construction and use of national public security video imaging information systems. Local governmental public security organs at the county level and above are responsible for supervision and management work for the construction and use of public security video imaging information systems in their own administrative area(s).

Competent administrative departments for development and reform, finance, housing and urban-rural development, transportation, industry and information technology, and quality technological supervision etc., implement guidance and supervision responsibilities for construction and management of national public security video imaging information systems, etc., and other matters within the scope of their own responsibility.

Article 5: [government responsibility]县级以上人民政府应当将公共安全视频图像信息系统建设纳入本地区经济社会发展中长期规划、城乡规划,加强统筹协调,鼓励、支持和引导社会力量参与公共安全视频图像信息系统的建设。

Article 6: [protection of secrets and privacy]任何单位和个人,不得利用公共安全视频图像信息系统非法获取国家秘密、工作秘密、商业秘密或者侵犯公民个人隐私等合法权益。

公共安全视频图像信息系统的建设、使用等单位,对于系统设计方案、设备类型、安装位置、地址码等基础信息,以及获取的涉及国家秘密、工作秘密、商业秘密的视频图像信息负有保密义务,对于获取的涉及公民个人隐私的视频图像信息不得非法泄露。

Article 7: [principles of establishment]建设公共安全视频图像信息系统,应当遵循统筹规划、统一标准、安全可控的原则。

Article 8: [integration and sharing of resources]为了维护公共安全,县级以上地方人民政府可以对本辖区内的公共安全视频图像信息系统进行资源整合,实现视频图像信息的共享。

Article 9: [establishment scope and entities]社会公共区域的重点部位以及法律、行政法规规定的有关场所或者部位,应当建设公共安全视频图像信息系统。

社会公共区域的公共安全视频图像信息系统由政府组织建设和维护,纳入公共基础设施进行管理,所需费用列入本级政府预算。

Article 10: [express identification]社会公共区域的视频图像采集设备,应当设置提示标识,标识应当醒目。

Article 11: [reasonable set-up]社会公共区域的视频图像采集设备的安装位置应当与居民住宅等保持合理距离。

旅馆客房、集体宿舍以及公共浴室、更衣室、卫生间等可能泄露他人隐私的场所、部位,禁止安装视频图像采集设备。

Article 12: [system construction specifications]建设公共安全视频图像信息系统,建设单位应当按照相关标准组织设计方案可行性论证、设备选型和工程竣工验收;未经验收或者验收不合格的,不得投入使用。

建设单位应当自系统验收合格之日起30日内,将系统使用的主要设备类型、点位分布等资料向所在地县级以上人民政府公安机关备案。

Article 13: [requirements for establishment within buildings]建设公共安全视频图像信息系统,其所在的建筑物属于新建、改建、扩建项目的,应当与主体工程同步设计、同步施工、独立验收,并同时投入使用。

Article 14: 【建设资料管理】公共安全视频图像信息系统的建设单位、使用单位,应当将系统设计、施工、验收、维护等基础资料,以及从事上述活动的单位和专业技术人员的基本信息立卷归档,依法管理、保存。

Article 15: [requirements for the prohibition of impeding operations]设置户外广告、架设管线、园林绿化或者安装其他设施,不得妨碍社会公共区域已经建成的公共安全视频图像信息系统正常运行或者视频图像信息正常采集。

Article 16: [network transmission requirements]公共安全视频图像信息系统传输网络运营服务的提供方,应当加强网络传输的安全管理,保障网络运行安全,以及视频图像信息传输的稳定安全。

Article 17: [system security operations]公共安全视频图像信息系统的使用单位,应当履行下列职责:

(一)建立并落实值班监看、运行操作等管理制度和突发事件处置预案;

(二)对系统的监看、操作维护等人员进行法律知识、保密知识和岗位技能培训;

(三)建立并落实系统定期检查和维护保养制度;

(四)建立并落实系统效能和安全性能的定期评估制度。

Article 18: [information protection measures]公共安全视频图像信息系统的使用单位,应当采取授权管理、控制访问等措施,控制对视频图像信息的查阅、复制和传输,保障信息不被删除、修改和非法复制、传输。

Article 19: [provisions on limitations of use]视频图像信息用于公共传播时,除法律另有规定外,应当对涉及当事人的个体特征、机动车号牌等隐私信息采取保护性措施。

Article 20: [information management requirements]公共安全视频图像信息系统的使用单位,应当建立信息保存、使用等管理制度。采集的视频图像信息至少留存30日,法律、行政法规或者相关标准规定多于30日的,从其规定。

Article 21: [special use of information]行使侦查、检察、审判职权的机关因司法工作需要,公安机关、国家安全机关因行政执法工作需要,或者县级以上人民政府行政主管部门因调查、处置突发事件需要,可以查阅、复制或者调取公共安全视频图像信息系统的基础信息或者采集的视频图像信息,相关单位或者个人应当予以配合。

Article 22: [Prohibitions]Units and individuals must not exhibit the following conduct:

(1) Stealing, damaging, or removing Public Security Video Imaging Information System facilities or equipment without authorization;

(2) Destroying, or making changes or deletions to Public Security Video Imaging Information System operations procedures or operations records without authorization;

(3) Making changes or deletions to, concealing, or destroying original video image information collected by the Public Security Video Imaging Information System during the period for retention;

(4) Selling or buying, or unlawfully using, reproducing, or transmitting basic information on the Public Security Video Imaging Information System or video image information it has collected;

(5) Other situations that influence the normal use of the Public Security Video Imaging Information System.

Article 23: [oversight and inspections]对依据本条例规定建设的公共安全视频图像信息系统,县级以上地方人民政府公安机关应当定期检查建设单位、使用单位相关管理制度的执行情况。监督检查包括下列内容:

(一)建设单位依法履行建设义务的情况;

(二)公共安全视频图像信息系统设计方案论证和工程验收情况;

(三)使用单位建立和执行日常运行和维护、信息管理和使用等制度情况;

(四)其他依法需要监督检查的事项。

Relevant units and individuals shall cooperate when public security organs carry out inspections.

Article 24: [prohibitions on acts of state organs and personnel]国家机关及其工作人员不得违法强制要求企事业单位、其他组织和个人建设公共安全视频图像信息系统,不得指定或者变相指定公共安全视频图像信息系统的设计、施工、维护单位以及设备的品牌、销售单位。

Article 25: [reports and accusations]任何单位和个人有权对公安机关等部门在履行对公共安全视频图像信息系统的监督管理职责时的违法行为进行检举、控告。收到检举、控告的机关,应当按照职责及时查处。

Article 26: [legal responsibility for obstructing resource integration]违反本条例第八条规定,拒绝、阻碍县级以上地方人民政府对公共安全视频图像信息系统进行整合的,由县级以上地方人民政府公安机关责令限期改正并予以警告;逾期不整改的,对单位处以一万元以上十万元以下罚款,对直接负责的主管人员和其他直接责任人员处以一千元以上五千元以下罚款。

Article 27: [legal responsibility for unlawful installation]违反本条例第十一条规定,在可能泄露他人隐私的场所、部位安装视频图像采集设备的,由县级以上地方人民政府公安机关责令立即拆除;拒不拆除的,依法申请人民法院强制拆除;单位安装的,对单位处一万元以上十万元以下罚款;个人安装的,对个人处一千元以上五千元以下罚款。

Article 28: [legal responsibility for violating requirements on construction and use]Where any of the following conduct violates these regulations, the public security organs for the local people's governments at the county level or above is to order corrections be made in a set time; and where corrections are not made in time, a fine of 10,000 and RMB 100,000 is given to the unit, and directly responsible management personnel and other directly responsible personnel are to be fined between 1,000 and 5,000 RMB.

(一)公共安全视频图像信息系统应当进行设计方案可行性论证而没有论证,或者不符合论证方案的;

(二)公共安全视频图像信息系统使用的设备不符合相关标准的;

(三)公共安全视频图像信息系统未经验收或者验收不合格即投入使用的;

(四)公共安全视频图像信息系统没有与主体工程同步设计、同步施工、独立验收的;

(五)设置户外广告、架设管线、园林绿化或者安装其他设施,妨碍社会公共区域的公共安全视频图像信息系统正常运行的;

(6) Refusing or obstructing relevant departments lawfully reviewing, reproducing, or collecting basic information on the Public Security Video Imaging Information System or video image information it has collected;

Article 29: [legal responsibility for filing and data management violations]Where there are violations of paragraph 2 of article 12, or article 14 of these regulations, the public security organs for the local people's governments at the county level or above is to order corrections be made in a set time; and where corrections are not made in time, a fine of 10,000 and 30,000 RMB is given to the unit, and directly responsible management personnel and other directly responsible personnel are to be fined between 1,000 and 5,000 RMB.

Article 30: [Legal responsibility for operations management violations]Where there are violations of articles 17, 18, or 20 of these Regulations, the public security organs for the local people's governments at the county level or above are to order corrections be made within a set time, and give a warning; and where circumstances are serious, a fine of 10,000 and RMB 30,000 is given to the unit, and directly responsible management personnel and other directly responsible personnel are to be fined between 1,000 and 3,000 RMB.

Article 31: [legal responsibility for violations of prohibitions] Where there are violations of article 22 of these regulations, the public security organs for the local people's governments at the county level or above are to order corrections for a period of time, and fine the unit between 10,000 and 100,000 yuan; persons who are directly in charge and other directly responsible personnel to be given warnings or a fine of between 1,000 and 5,000 yuan; and where violations are by individuals, fine the individual between 1,000 and 5,000 yuan where there is a violation by an individual, the individual is fined between 1,000 and 5,000 RMB.

Article 32: [punishment of state organ personnel]Where, in the course of performing their oversight and management duties, employees of state organs abuse their power, derelict their duties, or twist the law for personal gain, they are to be punished in accordance with law; where a crime is constituted, criminal responsibility is pursued in accordance with law.

Article 33: [Connections with Higher Level Law]Where violations of these Regulations constitute a violation of public security management, sanctions are to be given in accordance with the "Public Security Administrative Sanctions law of the People's Republic of China"; where a crime is constituted, criminal responsibility is pursued in accordance with law.

Article 34: [management of other compatible systems]建设、使用、整合与公共安全视频图像信息系统兼容集成的入侵报警、出入口控制等系统,参照本条例规定执行。
