The following opinions on protecting the lawful rights and interests of disablled persons are submitted on the basis of the "P.R.C. Law on the Protection of Persons with Disabilities" and relevant provisions, so as to further implement the directive of a judiciary for the people, and promoting social harmony and stability.

1. People's procuratorates handling cases involving people with disabilities shall strictly follow legal provisions, to implement the Party and State policies on the protection of rights and interests of persons with disabilities, focusing on care assistance for people with disabilities to facilitate their proceedings, to adopt effective measures to prevent conduct infringing on the rights and interests of persons with disabilities,to ensure persons with disabilities' full and equal participation in litigation activities and social life, and to promote the enjoyment and achievement of lawful rights and interests of persons with disabilities.

2. People's procuratorates may designate specialized personnel or set up a specialized groups to handle cases involving persons with disabilities. During case-handling, communication and coordination shall be strengthened with the Federation for the Disabled Persons and other societal organizations, relevant government departments and units, communities or village committee involved with persons with disabilities, to actively understand the situation, hear opinions and jointly work to protect the lawful rights and interests of persons with disabilities.

3. For crimes that infringe upon persons with disabilities security in their lives and property, especially for major cases of serious violations of the lawful rights and interests of persons with disabilities, cases of violations of the lawful rights and interests of people with disabilities as a group; strictly and quickly approve arrest, prosecute, and increase the intensity of the alleged offense.

4. For cases of forced labor of persons with intellectual disabilities, trafficking in disabled women or children, using violence or coercion to organizing persons with disabilities to beg, organizing begging after intentional injuring to cause disabilities; organizing, coercing or inciting persons with disabilities to carry out criminal activit, and other such cases are dealt with severely in accordance with law.

五、加大对侵害残疾人权益的职务犯罪的查处和预防,依法严惩挪用、克扣、截留、侵占残疾人教育、康复、就业、社会保障等资金和物资以及发生在涉及残疾人事业的设备采购、工程建设中的职务犯罪行为。

六、人民检察院在办理案件过程中发现有关单位存在侵犯残疾人合法权益行为的,应当依法及时向有关单位发出检察建议,督促其纠正。 侵犯残疾人合法权益情节严重,尚不构成犯罪的,人民检察院应当建议相关部门对责任人员给予相应处分;构成犯罪的,依法追究刑事责任。

七、对于残疾人涉嫌职务犯罪案件,人民检察院在对残疾犯罪嫌疑人进行第一次讯问或者采取强制措施时,应当告知其有权委托辩护人,并告知其如果符合《最高人民法院、最高人民检察院、公安部、司法部关于刑事诉讼法律援助工作的规定》第二条规定,本人及其近亲属可以向法律援助机构申请法律援助。

人民检察院自收到移送审查起诉的案件材料之日起三日以内,应当告知残疾犯罪嫌疑人有权委托辩护人,并告知其如果符合《最高人民法院、最高人民检察院、公安部、司法部关于刑事诉讼法律援助工作的规定》第二条规定,本人及其近亲属可以向法律援助机构申请法律援助。 对于残疾被害人,应当告知其本人及其法定代理人或者近亲属有权委托诉讼代理人,并告知其如果经济困难,可以向法律援助机构申请法律援助。

The people's procuratorates shall employ appropriate means to inform blind, deaf, dumb suspects of their rights, and ensure that they accurately understand the relevant provisions. For suspects with intellectual disabilities or mental illness, as well juvenile criminal suspects with disabilities, the obligation to inform shall be performed to their legally-designated representative.

8. Where criminal suspects are juveniles with disabilities; blind, deaf or dumb persons; or persons with mental illnesses who have not yet completely lost the ability to recognize or control their own conduct; or are disabled persons who might be sentenced to indeterminate imprisonment or death who have not retained a defender; the people procuratorates shall promptly notify the legal aid organization to assign a lawyer to provide them with a defense.

9. When people's procuratorates interrogate criminal suspects with disabilities, restraints shall be used with caution. Where there is truly a physical threat and it is necessary to use restraints, their use shall be immediately terminated when the threat is extinguished.

十、人民检察院审查逮捕残疾犯罪嫌疑人,除按照《中华人民共和国刑事诉讼法》第七十九条第一款的规定审查是否具备逮捕条件外,还应当根据犯罪嫌疑人涉嫌犯罪的性质、事实、情节、主观恶性和犯罪嫌疑人身体状况是否适宜羁押等因素综合考量是否确有逮捕必要,必要时可以对残疾犯罪嫌疑人的犯罪原因、生活环境等开展社会调查以作参考。 对于不采取强制措施或者采取其他强制措施不妨碍诉讼顺利进行的,应当作出不批准逮捕或者不予逮捕的决定。 对于可捕可不捕的应当不捕。 但是,对于反复故意实施犯罪,不羁押不足以防止发生社会危险性的,应当依法批准或决定逮捕。

十一、残疾犯罪嫌疑人、被告人被逮捕后,人民检察院应当对羁押必要性定期开展审查,综合考虑侦查取证的进展情况,案件事实、情节和证据的变化情况,残疾犯罪嫌疑人、被告人的身体健康状况等因素,对不需要或者不适宜继续羁押的,应当依法变更强制措施或者建议有关机关变更强制措施。

十二、对于残疾人犯罪案件,符合《人民检察院刑事诉讼规则(试行)》规定的条件,双方当事人达成和解协议的,人民检察院应当依法从宽处理。 符合法律规定的不起诉条件的,应当决定不起诉;依法必须提起公诉的,应当向人民法院提出从轻、减轻或者免除处罚的量刑建议。

十三、对于残疾被告人认罪并积极赔偿损失、被害人谅解的案件,未成年残疾人犯罪案件以及残疾人实施的具有法定从轻、减轻处罚情节的案件,人民法院量刑偏轻的,人民检察院一般不提出抗诉。

十四、人民检察院发现看守所、监狱等监管机关在羁押管理和教育改造残疾在押人员等活动中有违法行为的,应当依法提出纠正意见;发现看守所、监狱等监管场所没有对残疾在押人员在生活、医疗上给予相应照顾,没有采取适当保护措施的,应当通过检察建议等方式督促监管机关改正。

对残疾罪犯开展减刑、假释、暂予监外执行检察工作,可以依法适当从宽掌握,但是,反复故意实施犯罪的残疾罪犯除外。

十五、人民检察院在开展社区矫正法律监督活动中,发现社区矫正机构工作人员对残疾社区矫正人员有殴打、体罚、虐待、侮辱人格、强迫其参加超时间或者超体力社区服务等行为的,应当依法提出纠正意见。 情节严重,构成犯罪的,依法追究刑事责任。

十六、人民检察院发现强制医疗机构工作人员殴打、体罚、虐待或者变相体罚、虐待被强制医疗的精神病人,违反规定对被强制医疗的精神病人使用械具、约束措施等行为的,应当依法提出纠正意见。 情节严重,构成犯罪的,依法追究刑事责任。

十七、对于残疾人控告、举报、申诉案件应当依法快速办理,缩短办案周期。 对于不属于本院管辖的案件,应当先行接收,然后及时转送有管辖权的机关,并告知提出控告、举报、申诉的残疾人。

十八、复查涉及残疾人的刑事申诉案件,应当认真听取残疾申诉人或者其代理人的意见,核实相关问题,并可以听取原案承办部门、原复查部门或者原承办人员意见,全面了解原案办理情况,认真审核、查证与案件有关的证据和线索,查清案件事实,依法作出处理。

十九、对于已经发生法律效力的民事、行政裁判书、调解书,残疾当事人依法向人民检察院申请提出检察建议、抗诉,或者认为人民法院的执行活动违反法律规定、审判人员存在违法行为而向人民检察院申请监督的,人民检察院应当及时受理和审查,对确有违法情形的,依法提出检察建议或者抗诉,切实维护残疾人的合法权益。

20. Cases of persons with disabilities applying for compensation that meet the requirements for acceptance shall be handled rapidly, fully hearing the opinions of the disabled person of their representative. In cases where compensation shall be made in accordance with law, a compensation enforcement decision shall be promptly issued.

二十一、对于残疾人涉法涉诉信访案件,人民检察院应当按照中央政法委《关于建立律师参与化解和代理涉法涉诉信访案件制度的意见(试行)》的要求,为残疾人寻求律师帮助提供便利,对律师阅卷、咨询了解案情等合理要求提供支持,对律师提出的处理意见认真研究,及时反馈意见。 对确有错误或者瑕疵的案件,及时导入法律程序予以解决。

二十二、人民检察院在办理案件、处理涉法涉诉信访问题过程中,应当主动了解残疾当事人的家庭生活状况,对符合国家司法救助条件的残疾人,应当告知其有权提出救助申请。 对残疾人提出的救助申请,应当快速受理审查;对符合救助条件而没有提出申请的,应当依职权启动救助程序。 符合救助条件的,应当及时提出给予救助以及具体救助金额的意见,履行有关审批手续后及时予以发放。

23. Newly established reception facilities of people's procuratorates at all levels shall comply with the relevant requirements for accessible facilities; extant facilities that do not comply with the accessibility requirements should gradually be reformed to facilitate access by persons with disabilities.

24. 'Disabled persons' as used in these Opinions refers to disabled persons meeting the requirements of "The People's Republic of China Law on Protection of Persons with Disabilities" and the "Categorization and Classification of Disabled Persons" (GB/T26341-2010).
