排污许可管理条例(征求意见稿)

Chapter I: General Provisions

Article 1: [Legislative Purpose] This Management Regulation is established to standardize the pollution behaviours of enterprises and institutions as well as other manufacturers and operators, control pollutant discharges, and improve the quality of ecological environment, the Regulation is hereby formulated in accordance with the 'Environmental Protection Law of the People's Republic of China' and relevant laws and regulations.

Article 2: [Scope of Application] This Regulation applies to the management of application, approval and issuance, enforcement, and supervision of pollutant discharge permits.

Article 3: [Subjects of Application] This Regulation applies to the management of application, approval and issuance, enforcement, and supervision of pollutant discharge permits.

The term “pollutant discharge” used in this Regulation refers to the discharge of water pollutants or air pollutants, or the production of industrial solid wastes or other pollutants that are legally incorporated into the scope of the pollutant discharge permit management.

Article 4: [Fundamental Position] The pollutant discharge permit system is a basic environmental management system that standardizes the discharge behaviours of discharge units in accordance with laws.

The competent department of ecological environment implements the discharge permit system by approving and issuing pollutant discharge permits and performing supervision according to these permits. The pollutant discharge permit is the main legal instrument based on which discharge units accept environmental supervision and their competent departments of ecological environment impose the supervision during production and operation.

Discharging units shall apply for a pollutant discharge permit according to laws and discharge pollutants in accordance with the requirements of this permit. Discharging units that have not obtained discharge permits must not discharge pollutants.

Article 5: [Basic Principles] The competent departments for ecological environment are to persist in having improving the environmental quality as their core, and implement comprehensive permit management and coordinated control of multiple pollutants on discharge units. In areas where environmental quality is not up to standards, a stricter total amount control of pollutants shall be implemented by imposing stricter standards, and supervisions in the process and after the process shall be strengthened according to the permits to promote the improvement of environmental quality.

Article 6: [Classified Management] China implements a classified management of pollutant discharge permits based on factors such as produced amount of pollutants, discharge amount, and extent of environmental hazards.

For discharging units with relatively large amount of produced and discharged pollutants or with relatively high degree of environmental hazard, a focused management of discharge permit applies; for discharging units with relatively small amount of produced and discharged pollutants or with relatively low degree of environmental hazard, a simplified management applies; for discharging units with very small amount of produced and discharged pollutants or very low degree of environmental hazard, a management of discharge permit registration applies.

The competent department of ecological environment under the State Council is responsible for formulating and publishing a directory of pollutant discharge permits under classified management.

Article 7: [Management Authorization] The competent department of ecological environment of the State Council implements unified supervision and management upon nationwide pollutant discharge permitting.

The competent departments of ecological environment of provincial governments implement and supervise the permitting of pollutant discharge in the corresponding administrative regions.

The local competent departments of ecological environment above the level of city with districts where the production and operation sites of discharging units are located are responsible for approving and issuing pollutant discharge permits upon application and supervising the implementation of these permits.

Article 8: [Management Platform] The competent department of ecological environment of the State Council establishes, operates and manages the national information platform for pollutant discharge permit management.

The competent departments for ecological environment conducts online acceptance of applications, approval and issuance of permits, information disclosure, etc., through the information platform for pollutant discharge permit management to provide efficient and convenient services.

Article 9: [Requirements and Safeguards] The local governments at different levels shall include the expenditure required for the management of discharge permits into their financial budgets.

Chapter II: APPLICATION, APPROVAL AND ISSUANCE

Article 10: [Target of Applications] Discharging units under focused or simplified management of pollutant discharge permit shall apply for pollutant discharge permits to their competent departments of ecological environment that are entitled to approve and issue such permits in accordance with the provisions of this Regulation.

Discharging units that are under the same legal entity or other organization and located in different production and operation sites shall apply respectively in the name of such legal entity or organization.

If the production and operation site of an discharge unit is located in a different administrative region than its discharge outlets, the competent departments for ecological environment entitled with the power to approve and issue permits shall seek for the opinions of the competent departments for ecological environment that are located at the same place as these discharge outlets before approval and issuance; in case of inconsistent opinions, the shared superior competent department deals with the application.

Article 11: [Registration Management] Discharging units under registered management shall fill in and dynamically update registration forms on the national information platform for discharge permit management. The registration information includes the basic situation of the discharging units, the locations of discharge outlets, applicable pollutant discharge standards, and pollution prevention and treatment measures adopted. The discharging units are legally responsible for the authenticity and legality of the registered information.

The competent departments for ecological environment exempt the discharging units from environmental management requirements according to this Regulation, such as parameter records, execution reports and information disclosures.

Article 12: [Time Limits for Application] Discharging units shall apply for and obtain a pollutant discharge permit before their actual discharging occurs.

Article 13: [Application Materials] Discharging units under key or simplified management of pollutant discharge permit shall fill in and submit an application for discharge permit on the national information platform for discharge permit management, and send written application materials printed via this information platform to the competent departments for ecological environment which is entitled to approve and issue the permits. The discharging units are legally responsible for the authenticity and legality of these application materials.

The application materials shall include:

(1) An application form for pollutant discharge permit, mainly including basic information of the discharge unit, main production facilities, main products and production capacity, main raw and auxiliary materials, pollutant producing and discharging stages and pollutant prevention and treatment facilities, location and number of discharge outlets, discharging approach and direction, and pollutant types, discharge concentration and discharge amount that are applied for according to its discharge outlets and production facilities or plants, and the applicable standards;

(2) Self-monitoring plans;

(3) A letter of commitment signed or sealed by the legal representative or the principal of the discharge unit;

(4) Explanations on the standardization of its discharge outlets;

(5) The examination and approval number of the environmental impact assessment document of construction project;

(6) A statement form for information disclosure of the discharge unit, which shall be submitted as required before application.

(7) Discharging units with new construction, reconstruction, expansion and technological transformation after the implementation of this Regulation, whose total amount index of pollutant discharge is obtained through equal substitution or reduced substitution, shall provide the code of the pollutant discharge permit of the discharge unit that transfers the index or the materials related to this index change.

(8) Other materials as stipulated by laws and regulations

Where commercial secrets are involved in registration of major production facilities and main product capacity, the discharge unit shall make a statement, and the competent departments for ecological environment shall perform the duty of confidentiality according to laws.

Article 14: [Information Disclosure before Application] Before submitting the application materials for pollutant discharge permit, discharging units under key management of pollutant discharge permit shall disclose its basic information, proposed application items and a letter of commitment in an easily accessible manner to the public, such as via the national pollutant discharge permit management platform. The publishing duration period must not be less than five working days

Article 15: 【Acceptance】 After receiving the application materials submitted by the discharge unit, the entitled department shall review the integrity and standardization of these materials and deal with the application according to the following circumstances:

(1) Where it is not required of a discharge permit in accordance with this Regulation, the department shall notify the discharge unit of rejection on site or within five working days;

(2) If the application does not fall under the jurisdiction of the department, the department shall make a decision of rejection on site or within five working days, and inform the discharge unit to apply to an entitled department with the power to approve and issue corresponding permits;

(3) Where the application materials are incomplete or do not meet the requirements, a notice shall be issued on site or within five working days to inform the discharge unit of all the materials that need to be supplemented, and where it can be corrected on site, the discharge unit shall be allowed on site. Where no notice has been issued within a certain period of time, the application shall be deemed to have been accepted as of the date of receipt of the written application materials;

(4) If the application falls under the jurisdiction of the department, and the application materials are complete and meet all the requirements or the discharge unit submits all the supplemental materials as required, this application shall be accepted. The competent departments for ecological environment with the power to approve and issue permits shall make the decision of accepting or rejecting the application for pollutant discharge permit on the national pollutant discharge permit management platform, issue an acceptance note or a rejection note with its official seal and date to the discharge unit at the same time, and disclose the basic information, the proposed application items and the letter of commitment of the discharge unit.

Article 16: [Unified Coding] After the entitled department accepts the application from the discharging units, a unified code for this permit license shall be automatically generated via the national pollutant discharge permit management platform. The coding rules for discharge permits, pollution prevention and treatment facilities and discharge outlets are formulated and published by the competent departments for ecological environment of the State Council in accordance with the relevant provisions of the national Unified Social Credit Code.

Article 17: [Conditions for Non-Issuance] The entitled department shall not approve and issue a discharge permit in any of the following situations:

(1) The project is located within the prohibited area for construction as stipulated by laws and regulations, or does not meet the requirements of “Three Lines And One List” regional partition management and control system for ecological environment (red line of ecological protection, bottom line of environmental quality and upper limit line of resource utilization, and a negative list for environmental admittance);

(2) The products or the manufacturing equipment fall within the eliminated outdated items or the outdated items to be eliminated immediately that are prescribed in the catalogue of industrial policy jointly published by the departments of macroeconomic regulation and control and relevant departments of the State Council.

(3) The discharge unit does not obtain the review opinions of environmental impact assessment document for its construction project;

(4) The pollution prevention and treatment facilities used fail to meet the allowable discharge concentrations;

(5) Discharging units with new construction, reconstruction, expansion and technological transformation after the implementation of these Regulations, who obtain their total amount control index of pollutant discharge through equal substitution or reduced substitution, fail to provide the materials related to permit transfer of the discharge unit transferring the index.

(6) Other situations that are not allowed by laws and regulations.

Article 18: [Timing for Review] The entitled department shall make the decision on whether or not to grant permission within 20 working days from the date of accepting the application. Within ten working days from the date of the decision to grant the permission, the competent departments for ecological environment shall issue an discharge permit with the seal of the department to the discharge unit.

If the entitled department cannot make a decision within 20 working days, it may prolong the deadline by ten working days with the approval of the head of the department, and inform the discharge unit of the reasons for this extension.

Article 19: [Content of Permits] The discharge permit consists of one original copy and one duplicate copy with the original contains the basic information, and the duplicate copy contains the basic information, registered items, permitted matters, and letters of commitment.

The entitled department may add items that need to be specified in the permit according to local laws and regulations.

Article 20: [Basic Information] The following basic information shall be concurrently indicatedin both the original and the copy of the discharge permit:

(1) Basic information of the discharging unit, including the name of the unit, the registered address, the legal representative or the principal, the technical lead, the address of the production and operation site, the industry category, and the unified social credit code;

(2) Validity period of the permit, the issuing authority, the date of issuance, the permit number and the QR code.

Article 21: [Registration Items] The following registration items shall be reported by the discharge unit and recorded in the copy of the discharge permit:

(1) Main manufacturing facilities, main products and capacity, main raw and auxiliary materials, etc.;

(2) Pollutant producing and discharging stages and pollution prevention and treatment facilities;

(3) The review opinions of environmental impact assessment document, the total amount control indexes of key discharge pollutants decomposed and assigned to the discharge unit according to laws, and records of paid use and discharge transaction.

Article 22: [Permitted Matters] The following permit matters applied for by discharging units are to be specified in the copy of the discharge permit after being reviewed by the entitled department:

(1) The location and amount of discharge outlets, discharging approach and direction, etc., and locations and amount of disorganized discharge sources of air pollutants;

(2) Types of pollutants discharged from discharge outlets and disorganized discharge sources, permissive discharge concentrations, and permissive discharge amount;

(3) Environmental management requirements that shall be observed after obtaining the discharge permit;

(4) Other permit matters as stipulated by laws and regulations.

For the discharging units with review opinions of environmental impact assessment document, the contents related to the pollutant discharge in the environmental impact assessment document and the approval opinions shall be included in the discharge permit.

Article 23: [Determining Allowable Discharge Concentration] The entitled department shall, according to the national and local pollutant discharge standards, verify allowable discharge concentrations at discharge outlets and disorganized discharge sources.

Where discharging units make a commitment to implement a more stringent discharge concentration, this concentration shall be specified in the copy of the discharge permit.

Article 24: [Determining Allowable Discharge Volume] Allowable discharge quantities include permissive annual (season, month, day) discharge amount, and allowable discharge amount for special periods.

The entitled department shall strictly verify the allowable discharge amount of the discharge unit according to the technical requirements for application and issuance of discharge permits, review opinions of environmental impact assessment document, and total amount control indexes of key discharge pollutants.

Where discharging units are required to implement more stringent key pollutant discharge control indexes by the local people's government in accordance with the requirement of environmental quality improvement, the compliance plan for environmental quality deadlines and the responsive measures for heavy pollution weather, this requirement shall be specified in the copies of their discharge permits.

The technical requirements for application and issuance of discharge permits are uniformly formulated and published by the competent departments for ecological environment of the State Council.

Article 25: [Discharge Trading] The permissive discharge amount in the discharge permit can be used as the ownership basis for discharge index trading.

The achieved reduction of pollutant discharges by the discharge unit through capacity reduction, cleaner production, deep pollution treatment or technological transformation and upgrading, if meeting the requirements for permissive discharge amount, can be offered for sale in the market accordingly. Whereas, the reduced discharge amount achieved through technological upgrading and transformation by the discharge unit for meeting the standards that it has previously failed to meet may not be used for trading.

Article 26: [Confirmation of Environmental Management Requirements] The following environmental management requirements shall be specified in the copy of the discharge permit by the entitled department according to the application materials, relevant technical specifications and regulatory requirements of the discharge unit:

(1) Requirements regarding operation and maintenance of pollution prevention and treatment facilities, standardization of discharge outlets, and disorganized discharge control;

(2) Requirements regarding discharge prohibition or restriction of discharge facilities or processes during special periods such as responsive measures to heavy pollution weather and guarantee measures for major events;

(3) Requirements regarding self-monitoring, detailed statement, content and frequency of implementation report, as well as environmental management requirements regarding soil and underground water pollution if applicable;

(4) Information disclosure requirements for the discharging units;

(5) Other obligations regarding pollutant discharge control according to laws and regulations.

Article 27: [Permit Validity Period] The discharge permit comes into effect from the date of permit confirmation. The initial discharge permit is valid for three years, and the renewed permit is valid for five years.

Where the manufacturing equipment and products of the discharge unit fall within the planned phase-out catalogue of the relevant departments of the State Council, the validity period of the discharge permit shall be consistent with the planned phase-out deadline.

Chapter III: DISCHARGE UNDER PERMIT

Article 28: [Discharge with Permit] The discharging units shall fulfil the commitments in applications for the discharge permits by complying with the included permitted items, operating and maintaining the pollution prevention and treatment facilities in accordance with the environmental management requirements, adopting cleaner processes with high utilization efficiency of raw materials and less pollutant discharge, and strengthening the internal management to strictly control its pollutant discharge.

Article 29: [Discharge Outlet Set up] The discharge unit shall set up pollutant discharge outlets in accordance with laws and regulations and the specifications of the competent departments for ecological environment, and set signboards for these discharge outlets.

Location and amount of discharge outlets, discharging approach and direction and pollutant control measures shall be consistent with the permitted items in the discharge permit and shall not be changed without approval. Discharging units with new construction, reconstruction, expansion, and technological transformation and treatment projects with a prescribed time limit must build standardized discharge outlets while building pollution treatment facilities, and report on this to the competent departments of ecological environment.

Article 30: [Type of Discharged Pollutant] Discharging units may discharge pollutants provided for in the discharge permit, and where pollutants are not specified, they shall promptly report to the competent department for the ecological environment and relevant departments, and promptly update the discharge permit, or halt this discharge.

Article 31: [Prevention and Treatment of Illegal Discharge] Discharging units shall strictly prevent and treat illegal discharge according to the requirements of the discharge permit by centralized collection or sealing and employing measures to prevent permeation, leakage, and so forth.

Article 32: [Self-monitoring] Discharging units shall, in accordance with the provisions of the discharge permit, install or use apparatus that comply with relevant national ecological environment monitoring and metrological certification, maintain and monitor the facilities as required, conduct self-monitoring, disclose monitoring information in a timely manner, and preserve original monitoring records.

Discharging units under key management of pollutant discharge permit shall install automatic monitoring equipment in accordance with the regulations of the discharge permit and relevant standards and specifications, and connect to the monitoring equipment of the competent department to ensure normal operation of these monitoring equipment and disclose the monitoring information as required by laws. Discharging units shall be responsible for the authenticity and accuracy of monitoring data, and shall not have the data falsified, manipulated or forged by itself or through instructions. When discharging units find the data transmission by the automatic monitoring equipment abnormal, it shall promptly check, repair, record and report it.

Article 33: [Ledger records] Discharging units shall establish a detailed statement system for environmental management to record the operation status of the main production facilities and pollution prevention and treatment facilities as well as excessive discharge and other abnormal conditions according to the specified requirements for format, content and frequency of relevant regulations, as well as pollutant discharge concentration and actual discharge amount. The retention period of this detailed statement shall be no less than five years.

When over-discharging or abnormal conditions are found, the discharging units shall immediately take measures to avoid pollution accidents, eliminate or mitigate the consequences, and report to the responsible department in time.

Article 34: [Implementation Reports] Discharging units shall report the implementation details in a timely and sincere manner according to the content, frequency and time as required in relevant regulations, check whether the pollutant discharge behaviours, the discharge concentration and the actual discharge amount meet the requirements of the permitted items in the discharge permit, be held liable for the authenticity and integrity of the report, and disclose the information as required.

If no pollution is produced and discharged due to production halt within the validity period, it shall be stated as it is in the implementation report.

Article 35: [Cooperation for Inspection] Discharging units shall cooperate with the competent department for supervision and inspection by proactively presenting their pollutant discharge permits, truthfully communicating the situations and providing detailed statement, implementation report and other related materials.

Article 36: [Information Disclosure] Discharging units shall truthfully record and disclose the pollutant discharge information on the national information platform for pollutant discharge permit management in accordance with the regulations of the discharge permit. This pollutant discharge information mainly includes discharge concentration and actual discharge amount, construction and operation of pollution prevention and treatment facilities, self-monitoring data, and implementation report.

Article 37: 【License Management】 Discharging units shall properly keep their discharge permits to ensure that the discharge permit remains intact and is not damaged, and shall hang the original permit at an easily accessible position at the production and operation site for public supervision. It is forbidden to alter the discharge permit or use a forged one. It is forbidden to transfer the discharge permit by way of renting or borrowing.

Chapter IV: Supervision and Management

Article 38: [On-site Inspections] After the discharging units under key management of pollutant discharge management obtain pollutant discharge permits, the entitled department shall organize and implement an on-site check on the authenticity of the basic information, registration items and permitted items of the discharge permit within 60 days. Where the result is not satisfactory, the pollutant discharging unit shall be ordered to rectify and reform its discharge or correct the discharge permit; and where they refuse to make corrections or the permit cannot be corrected, the permit shall be revoked as required by laws. Where it is found that the pollutant discharge violates the provisions of the discharge permit, the environmental enforcement authorities shall promptly be informed of this violation.

Article 39:[Enforcement Inspections] The environmental law enforcement authorities or other departments responsible for supervised management of ecological environmental protection shall perform on-site law enforcement inspections in accordance with enforcement norms, or conduct off-site law enforcement inspections based on relevant data on the national information platform for pollutant discharge permit management and other written materials.

The local competent department of ecological environment at or above the districted municipality level shall designate the pollutant discharge unit that implements the key management of pollutant discharge permit as the key discharging units.

Article 40:[Inspection frequency] 生态环境执法机构应当将排污许可执法检查纳入生态环境执法年度计划。 在排污许可证有效期内,至少应当对实行排污许可重点管理和简化管理的排污单位开展一次执法检查。 对于有多次违规记录的排污单位,应当提高检查频次。 对于季节性生产的排污单位,应当在生产季节开展检查。

Article 41: 【排放浓度检查】 生态环境主管部门可通过国家排污许可管理信息平台监控排污单位的污染物排放浓度,发现存在排放浓度高于许可排放浓度的,应当要求排污单位及时提供台账记录、执行报告和自行监测数据进行核实,判定污染物排放浓度是否符合排污许可证规定,如有必要应当及时组织执法监测。

生态环境主管部门可通过执法监测、自动监测、国家排污许可管理信息平台获得排污单位污染物排放浓度,排放浓度不符合许可排放浓度要求的或者不符合执法监测相关规定的,可作为处罚证据。

Article 42: 【排放总量检查】 生态环境主管部门按照本条例第二十四条确定排污单位许可排放量,通过对照生态环境主管部门监督管理和执法检查数据,以及排污单位的台账记录、自行监测数据、执行报告等材料,检查排污单位在规定周期内的污染物排放总量。

Article 43:【污染防治设施检查】 生态环境主管部门应当对照台账记录和现场情况判定污染防治设施运行和维护是否符合排污许可证规定。

国务院生态环境主管部门组织编制污染防治可行技术指南。 对于不采用国家污染防治可行技术指南所规定可行技术的,应当根据执行报告、台账记录、自行监测数据和监督性监测数据,综合判定是否能够稳定达到排污许可证要求,并对不能稳定达标的,增加检查频次。

Article 44:【效力判定】 国家排污许可管理信息平台中记录的排污许可证相关电子信息与排污许可证正本、副本具有同等效力。 排污单位自行监测数据与符合法定的监测标准和监测方法的执法监测数据不一致的,以执法监测数据为准。 执法监测与自行监测数据不一致的认定标准由生态环境主管部门另行规定。

Article 45:【数据应用】 台账记录和执行报告信息可以作为检查和执法依据。

执行报告中的实际排放量可以作为环境保护税征收、年度生态环境统计、污染物总量考核、污染源排放清单编制的重要参考。

Article 46:【委托技术服务】 生态环境主管部门可以通过政府购买服务的方式,组织或者委托技术服务机构提供下列技术服务:

(一)协助完成排污许可证申请材料审核;

(二)协助实施排污许可监督、管理工作,包括但不限于协助核查排污单位自行监测数据、台账记录和执行报告以及协助开展各项抽查、专项检查等;

(三)协助开展排污许可制度持续跟踪研究;

(四)协助建设、运行和管理国家排污许可管理信息平台。

技术服务机构应当对其提供的服务内容负责,不得收取排污单位任何费用。

Article 47:【执法结果】 执法人员应当坚持处罚与教育相结合,告知排污单位存在的问题和相关要求,教育排污单位自觉守法。

依据本条例对排污单位的处罚结果,生态环境主管部门应当向社会公开。

Article 48:【信用管理】 生态环境主管部门应当将无证排污或者不按证排污对环境造成严重影响的,以及多次被生态环境主管部门通报的排污单位有关信息向社会公开,将其生态环境违法行为纳入社会信用体系。

生态环境主管部门对吊销排污许可证、禁止或停止排放污染物之外的违证排污行为,除依法给予行政处罚外,实行累积计分制度,累计积分达到规定分值,或一年内罚款三次以上的排污单位,实行红牌警示,吊销排污许可证,半年内不得重新申请。 具体办法由国务院生态环境主管部门规定。

生态环境主管部门对多次、严重违反排污许可证排放污染物的排污单位,应当予以限制或实施市场禁入措施,降低信用评定等级,加强审查力度,提高执行报告频次,并列入行业黑名单。 具体办法由国务院生态环境主管部门规定。

Article 49: [oversight and inspections] 上级生态环境主管部门应当对下级生态环境主管部门排污许可证核发和监管情况进行监督检查,及时纠正排污许可实施中的不当行为。

Article 50:[Societal Supervision] 鼓励公民、法人和其他组织向生态环境主管部门举报排污单位违反本条例行为。

接受举报的生态环境主管部门应当依法处理,及时对被举报的排污单位进行执法检查,按照有关规定对调查结果予以反馈,为举报人保密。

Chapter V: 变更、延续、撤销

Article 51:【变更情形】 在排污许可证有效期内,下列与排污单位有关的事项发生变化的,排污单位应当在规定时间内向原核发排污许可证的生态环境主管部门提出变更排污许可证的申请:

(一)排污单位名称、地址、法定代表人或者主要负责人等正本中载明的基本信息发生变更之日后三十个工作日内;

(二)排污单位在原场址内实施新建、改建、扩建项目和技术改造项目应当开展环境影响评价的,在取得环境影响评价文件审批意见后,排污行为发生变更之日前三十个工作日内;

(三)因排污单位原因,许可事项发生变更之日前三十个工作日内;

(四)产生新的法律法规要求或现行法律法规要求发生变化的,自法律法规实施之日后三十个工作日内;

(五)新制修订的国家和地方污染物排放标准实施前三十个工作日内;

(六)地方人民政府依法制定的重污染天气应急预案、特殊时段要求实施后三十个工作日内;

(七)依法分解落实的重点污染物排放总量控制指标发生变化后三十个工作日内;

(八)地方人民政府依法制定的限期达标规划实施后三十个工作日内;

(九)法律法规规定需要进行变更的其他情形。

Article 52:【变更申请】 排污单位申请变更排污许可证的,应当提交下列申请材料:

(一)变更排污许可证申请;

(二)由排污单位法定代表人或者主要负责人签字或者盖章的承诺书;

(三)与变更排污许可事项有关的其他材料。

排污单位应当书面承诺对变更申请材料的真实性、合法性、完整性负法律责任,并严格执行变更后排污许可证的规定。

发生本条例第五十一条第(一)项变更的,还应当提交排污许可证正本。

发生本条例第五十一条第(二)至(九)项变更的,还应当提交排污许可证副本。

Article 53:【变更决定】 生态环境主管部门应当对变更申请材料进行审查,符合法定条件、标准的,应当依法办理变更手续,作出变更决定的,在国家排污许可管理信息平台上公告。

发生本条例第五十一条第(一)项变更的,在排污许可证副本中记录变更事项,并换发排污许可证正本,收回原排污许可证正本。

发生本条例第五十一条第(二)至(五)项变更的,换发排污许可证副本,收回原排污许可证副本。

发生本条例第五十一条第(六)至(九)项变更的,在排污许可证副本中记录变更事项和变更后许可事项。

属于本条例第五十一条第(一)项情形的,排污许可证的起止期限不变;属于本条例第五十一条第(二)至(九)项情形的,变更后排污许可证期限自变更之日起计算,自原排污许可证有效期截止日期止。

属于本条例第五十一条第(一)项情形的,生态环境主管部门应当自受理变更申请之日起十个工作日内作出变更决定;属于本条例第五十一条规定的其他情形的,应当自受理变更申请之日起二十个工作日内作出变更许可决定。

Article 54:【延续情形】 排污许可证有效期需要延续的,排污单位应当在排污许可证有效期届满前三十个工作日内向原核发排污许可证的生态环境主管部门提出申请。

Article 55:【延续申请】 申请延续排污许可证的,应当提交下列材料:

(一)延续排污许可证申请;

(二)由排污单位法定代表人或者主要负责人签字或者盖章的承诺书;

(三)排污许可证正本和副本;

(四)与延续排污许可事项有关的其他材料。

Article 56:【延续决定】 生态环境主管部门应当按照本条例第五十五条规定对延续申请材料进行审查,并自受理延续申请之日起二十个工作日内作出延续或者不予延续许可决定。

作出延续许可决定的,向排污单位发放加盖本行政机关印章的排污许可证,收回原排污许可证正本和副本,同时在国家排污许可管理信息平台上公告。

Article 57:【撤销】 有下列情形之一的,生态环境主管部门或者其上级行政机关,可以撤销排污许可证并在国家排污许可管理信息平台上公告:

(一)超越法定职权核发排污许可证的;

(二)违反法定程序核发排污许可证的;

(三)核发人员滥用职权、玩忽职守核发排污许可证的;

(四)对不具备申请资格或者不符合法定条件的申请人准予排污许可的;

(五)依法可以撤销排污许可证的其他情形。

以欺骗、贿赂等不正当手段取得排污许可证的,应当予以撤销。 依照前款规定撤销排污许可证,可能对供暖、供水、污染治理等公共利益造成重大损害的,不予撤销。

Article 58:【Withdrawal】 排污单位依法取得的排污许可证受法律保护,生态环境主管部门或者其上级行政机关不得擅自改变已经生效的排污许可证。 排污许可证所依据的法律、法规、规章修改或者废止,或者准予行政许可所依据的客观情况发生重大变化的,为了公共利益的需要,生态环境主管部门或者其上级行政机关可以依法撤回已经生效的排污许可证,并在国家排污许可管理信息平台上公告。 由此给排污单位造成财产损失的,生态环境主管部门或者其上级行政机关应当依法给予补偿。

Article 59:【注销】 有下列情形之一的,生态环境主管部门应当依法办理排污许可证的注销手续,并在国家排污许可管理信息平台上公告:

(一)排污许可证有效期届满,未延续的;

(二)排污单位依法终止的;

(三)排污许可证依法被撤销、撤回,或者排污许可证依法被吊销的;

(四)因不可抗力导致排污许可事项无法实施的;

(五)应当注销的其他情形。

Article 60:【遗失补办】 排污许可证发生遗失、损毁的,排污单位应当在三十个工作日内向生态环境主管部门申请补领排污许可证。 遗失排污许可证的,在申请补领前应当在国家排污许可管理信息平台上发布遗失声明。 损毁排污许可证的,应当同时交回被损毁的排污许可证。

生态环境主管部门应当在收到补领申请后十个工作日内补发排污许可证, 并在国家排污许可管理信息平台上公告。

Chapter VI: Legal Responsibility

Article 61:【无证排污】 排污单位未取得排污许可证排放污染物,有下列行为之一的,由设区的市级以上地方生态环境主管部门责令停止排污或停产整治,对实行排污许可重点管理的排污单位并处每日五千元以上五万元以下的罚款,对实行排污许可简化管理的排污单位并处每日二千元以上二万元以下的罚款;第(一)至(三)项情节严重的及第(四)项,应当报经有批准权的人民政府批准,责令拆除、停业、关闭:

(一)依法应当申请排污许可证但未申请或者申请后未取得排污许可证排放污染物的;

(二)排污许可证有效期届满后未申请延续排污许可证或者延续申请未经设区的市级以上地方生态环境主管部门许可启动生产设施或排放污染物的;

(三)被依法撤销、注销、吊销排污许可证后仍排放污染物的;

(四)第十七条规定的不予核发排污许可证的排污单位仍排放污染物的。

实行排污许可登记管理的排污单位未依照本条例填写登记表的,由设区的市级以上地方生态环境主管部门责令登记,并处五万元以下罚款。

Article 62:[Violation of Standardization Requirements for Discharge Outlets] For any discharge unit in violation of the provisions of this Regulation and with any of the following actions, the local competent department above the level of city with districts shall order to correct, restrict its production or stop the production for regulation, and impose a fine of not less than twenty thousand Yuan but not more than two hundred thousand Yuan; in case of serious violation, termination of business or shut-down shall apply with report to and approval of the people's government with such power.

(1) The locations and amount of discharge outlets do not meet the requirements;

(2) Discharging approach and direction do not meet the requirements;

(3) The specific measures for controlling pollutants do not meet the requirements;

(4) Unpermitted types of pollutants

Article 63:【超浓度超总量】 违反本条例规定,超过许可排放浓度、超过许可排放量排放污染物的,由设区的市级以上地方生态环境主管部门责令改正或者限制生产、停产整治,每种污染物、每个排污口分别处十万元以上一百万元以下的罚款;情节严重的,报经有批准权的人民政府批准,责令停业、关闭。

Article 64:【违反管理要求排污】 违反本条例规定,有下列行为之一的,由设区的市级以上地方生态环境主管部门责令改正,并处二万元以上二十万元以下罚款;情节严重的,可处二十万元以上一百万元以下的罚款:

(一)未按照要求防治无组织排放的;

(二)特殊时段未禁止或限制排污设施或工艺排放污染物的;

(三)未采取措施防止泄漏、渗漏、遗撒、扬散的;

(四)超过排污许可证规定的固体废物贮存、转移、利用、处置种类、重量或者数量的;

(五)违反环境管理要求的其他情形。

Article 65: 【违反监测设施要求】 违反本条例规定,有下列行为之一的,由设区的市级以上地方生态环境主管部门责令改正,并处二万元以上二十万元以下的罚款;情节严重的,可处二十万元以上一百万元以下的罚款;拒不改正的,责令停产整治:

(一)侵占、损毁或者擅自移动、改变生态环境质量监测设施或者污染物排放自动监测设备的;

(二)未按照要求安装、使用污染物排放自动监测设备或者未按照要求与生态环境主管部门的监控设备联网,并保证监测设备正常运行的。

Article 66:【违反自行监测要求】 违反本条例规定,有下列行为之一的,由设区的市级以上地方生态环境主管部门责令改正,并处二万元以上二十万元以下的罚款;情节严重的,可处二十万元以上一百万元以下的罚款:

(一)未按照要求开展自行监测的;

(二)未按照要求保存原始监测记录的;

(三)未按照要求提交自行监测数据的;

(四)篡改和伪造监测数据,自行监测数据不真实、不完整的。

Article 67:【逃避监管】 违反本条例规定,有下列行为之一的,由设区的市级以上地方生态环境主管部门责令改正,可处十万元以上一百万元以下的罚款:

(一)偷排;

(二)以逃避现场检查为目的临时停产;

(三)非紧急情况下开启应急排放通道;

(四)不正常运行污染防治设施。

Article 68:【违反预处理要求】 未按照规定进行水污染物预处理,向集中处理设施排放不符合处理工艺要求的污染物的,由设区的市级以上地方生态环境主管部门责令改正或者限制生产、停产整治,并处十万元以上一百万元以下的罚款;情节严重的,报经有批准权的人民政府批准,责令停业、关闭。

Article 69:【违反台账记录(按日计罚)】 违反本条例规定,有下列行为之一的,由设区的市级以上地方生态环境主管部门责令改正,并处每日一千元以上二万元以下的罚款;拒不改正的,依法作出处罚决定的行政机关可以自责令改正之日的次日起,按照原处罚数额按日连续处罚:

(一)未按照排污许可证规定要求记录台账的;

(二)台账内容不真实、不完整的。

Article 70:【违反执行报告(按次计罚)】 违反本条例规定,有下列行为之一的,由县级以上地方生态环境主管部门责令改正,并处每次五千元以上十万元以下的罚款;拒不改正的,责令停产整治:

(一)未按照排污许可证规定要求提交执行报告的;

(二)执行报告内容不真实、不完整的。

Article 71:【违反信息公开】 违反本条例规定,有下列行为之一的,由县级以上地方生态环境主管部门责令限期改正,并处二万元以上二十万元以下的罚款:

(一)未按照排污许可证规定公开有关信息的;

(二)不如实公开有关信息的。

Article 72:【不配合检查】 排污单位拒不配合设区的市级以上地方生态环境主管部门检查,或者在接受检查时弄虚作假的,由设区的市级以上地方生态环境主管部门责令改正,并处二万元以上二十万元以下罚款;情节严重的,吊销排污许可证。

Article 73:【材料弄虚作假】 排污单位以隐瞒、提供虚假材料、欺骗、贿赂等不正当手段取得排污许可证的,设区的市级以上地方生态环境主管部门责令改正,并处二万元以上二十万元以下罚款;情节严重的,吊销排污许可证,三年内不得重新申请排污许可证,并处二十万以上一百万以下罚款。

前款规定的排污单位以不正当手段取得排污许可证的,由生态环境主管部门对直接负责的主管人员和其他直接责任人员,处一万以上五万以下罚款;情节严重的,十年内禁止从事相关业务;构成犯罪的,终身禁止从事相关业务。

Article 74:【证书管理不善】 排污单位涂改排污许可证、非法转让排污许可证、遗失后未及时补办排污许可证的,由设区的市级以上地方生态环境主管部门责令改正,并处一万元以上十万元以下罚款。

Article 75:【未按时变更】 发生本条例第五十一条变更情形,而排污单位未按时变更的,并由设区的市级以上地方生态环境主管部门责令改正,并处一万元以上十万元以下罚款。

Article 76:【刑事处罚】 违反有关法律规定,应当依法追究刑事责任的,从其规定。

Article 77:[Detention] 排污单位有下列行为之一,尚不构成犯罪的,除依照有关法律法规和本条例规定予以处罚外,生态环境主管部门或者其他有关部门将案件移送公安机关,对其直接负责的主管人员和其他直接责任人员,处十日以上十五日以下拘留;情节较轻的,处五日以上十日以下拘留:

(一)未取得排污许可证排放污染物,被责令停止排污,拒不执行的;

(二)通过暗管、渗井、渗坑、灌注或者篡改、伪造监测数据,或者不正常运行防治污染设施等逃避监管的方式违法排放污染物的。

Article 78:【从轻处罚】 排污单位有下列情形之一的,应当从轻处罚:

(一)及时报告异常情况或者超标情况的;

(二)主动采取措施消除或者减轻违法行为危害后果,且造成的环境影响程度较轻、影响范围较小的;

(三)配合生态环境主管部门查处违法行为有立功表现的。

Article 79:【从重处罚】 排污单位有下列情形之一的,应当从重处罚:

(一)拒绝、阻挠设区的市级以上地方生态环境主管部门检查,或者在接受检查时弄虚作假的;

(二)伪造自动监测数据或者干扰自动监测设施的;

(三)收买、贿赂检查人员的。

Article 80:【许可不免除其他法律责任】 排污单位持有排污许可证,不免除其因污染环境、破坏生态的行为承担其他法律责任。 排污单位不应以持有排污许可证为由主张不承担其他法律责任。

Article 81:【许可与处罚独立并行】 有核发权的生态环境主管部门在排污许可证核发过程中,发现符合排污许可证核发条件的排污单位存在其他生态环境违法行为的,应当在核发排污许可证的同时,依法督促整改,并移交生态环境执法机构予以行政处罚。

Article 82:【第三方责任】 设区的市级以上地方生态环境主管部门发现委托的技术服务机构隐瞒篡改、弄虚作假、重大错误、恶意串通等情况,应当立即解除服务关系,记入诚信档案,并在国家排污许可管理信息平台上公布有关信息;构成犯罪的,依法追究刑事责任。

排污单位应当对其委托的技术服务机构履行监督义务,并对委托的技术服务机构的行为承担责任。 受委托的技术服务机构与排污单位恶意串通造成严重后果的,应当与排污单位承担连带责任。

对于第三方服务机构弄虚作假的,由生态环境主管部门处以十万以上五十万以下罚款;情节严重的,禁止从事第四十六条规定业务,并处五十万以上一百万以下罚款;有违法所得的,没收违法所得。

前款规定的第三方服务机构出具虚假报告,由生态环境主管部门对直接负责的主管人员和其他直接责任人员,处一万以上五万以下罚款;情节严重的,十年内禁止从事第四十六条规定业务;构成犯罪的,终身禁止从事规定业务。

Article 83:【管理责任】 设区的市级以上地方生态环境主管部门在排污许可证受理、核发及监管执法中有下列行为之一的,由其上级行政机关或者监察机关责令改正,并对直接负责的主管人员或者其他直接责任人员依法给予行政处分;构成犯罪的,依法追究刑事责任:

(一)符合受理条件但未依法受理申请的;

(二)对符合许可条件的不依法准予核发排污许可证或者未在法定时限内作出准予核发排污许可证决定的;

(三)对不符合许可条件的准予核发排污许可证或者超越法定职权核发排污许可证的;

(四)滥用职权、玩忽职守、徇私舞弊的;

(五)实施排污许可证管理时擅自收取费用的;

(六)未依法公开排污许可相关信息的;

(七)不依法履行监督职责或者监督不力,造成严重后果的;

(八)其他应当依法追究责任的情形。

Chapter VII: Supplementary Provisions

Article 84:【海上排污许可证】 海上排污许可证生态环境保护管理,参照本条例执行,具体办法由国务院生态环境主管部门负责制定并公布。

Article 85:【保密规定】 涉及国家秘密的排污单位,其排污许可证的申请、受理、审核、发放、变更、延续、注销、撤销、遗失补办应当按照保密规定执行。

Article 86:【军事设施管理】 军事设施建设项目的环境保护管理,按照中央军事委员会的有关规定执行。
