The "Ministry of Civil Affairs' Measures on the Work of Accepting Foreign NGOs' Applications for it to be the professional supervisory unit for Establishment of Representative Offices professional supervisory units (provisional)" has already been reviews and passed by the Ministry of Civil Affairs 8th Ministers Administrative Meeting, and is hereby released to you; please follow it in handling relevant work on applications.

These Measures are drafted in accordance with the relevant provisions of the "PRC Law on the Management of Foreign Non-Governmental Organizations' Activities Within Mainland China", the "Catalog of Fields and Projects for Foreign NGOs with Activities in China, and Directory of Professional Supervisory Units (2017)"" (hereinafter the"Catalog"), and the "Handbook for Foreign Non-governmental Organizations' Registration of Representative Offices and Filing of Temporary Activities" (hereinafter the "Handbook"), so as to regulate the work of accepting foreign NGOs applications to establish representative offices with the Ministry of Civil Affairs serving as their professional supervisory unit.

I. Scope of Acceptance

Foreign NGOs that concurrently have the follow conditions may apply to have the Ministry of Civil Affairs serve as the professional supervisory unit for registering the establishment of representative offices:

(1) They are eligible under the provisions of article 10 of the "People's Republic of China Law on the Management of Foreign Non-Governmental Organizations' Activities within Mainland China"

(2) They meet the scope requirements for having the Ministry of Civil Affairs serve as professional supervisory unit as provided for in the "Catalog".

II. Materials that must be submitted:

(1) The foreign NGOs application to the Ministry of Civil Affairs to have it serve as the professional supervisory unit of a representative offices in mainland China (attachment 1);

(2) Table on the foreign NGO's activities carried out within mainland China (attachment 2);

(3) The materials that need to be submitted for establishment and registration indicated in items (2)-(11) of the "Handbook"

If the materials described above are in a foreign language, a Chinese translation must be attached, and all materials must be notarized and authenticated. Foreign NGOs shall be responsible for the authenticity and legality of the materials described above.

III. Acceptance of applications

The Ministry of Civil Affairs is to make a decision on whether or not to agree to be the professional supervisory unit within 60 working days of receiving all the valid materials listed in article 2 of these Measures. Where there are special circumstances, the period for making a decision may be extended, and the foreign NGO submitting the application is to be promptly informed; the extension must exceed 30 working days.

Where agreeing to be the professional supervisory unit, the relevant application form is to have a seal affixed in the name of the Ministry of Civil Affairs, and a letter of agreement is to be sent to the foreign NGO (attachment 3). Where no agreeing to be the professional supervisory unit, the foreign NGO submitting the application shall be promptly informed.

During the course of review and verification, the Ministry of Civil Affairs may further learn about circumstances relevant to the verification from the foreign NGOs.

IV. Other Matters

Representative offices of foreign NGOs that have already registered with the public security organs and have the Ministry of Civil Affairs as their professional supervisory unit, should send their annual work plans and annual work reports to the Ministry of Civil Affairs in accordance with provisions. Where modifications of registration matters or deregistrations need to be handled, an application shall be submitted to the Ministry of Civil Affairs in accordance with provisions, and after it agrees, go to the public security organs to handle it.
