各市州、县市区人民政府,省政府各厅委、各直属机构:

为贯彻落实《国务院办公厅关于加强个人诚信体系建设的指导意见》(国办发〔2016〕98号)等文件精神,切实加强个人诚信体系建设,弘扬诚信传统美德,增强社会成员诚信意识,褒扬诚信、惩戒失信,营造优良信用环境,提高社会信用水平,经省人民政府同意,制定以下实施意见。

I. Overall Requirements

1. Guiding Concepts: 全面贯彻党的十九大精神,坚持以习近平新时代中国特色社会主义思想为指导,以培育和践行社会主义核心价值观为根本,大力弘扬诚信文化,加快个人诚信记录建设,完善个人信息安全、隐私保护与信用修复机制,健全守信联合激励和失信联合惩戒机制,让诚信成为全社会共同的价值追求和行为准则,积极营造“守信光荣、失信可耻”的良好社会氛围。

(2) Basic principles. 按照政府推动、社会共建,健全法制、规范发展,全面推进、重点突破,强化应用、奖惩联动的原则,深入推进我省个人诚信体系建设,依托省级信用信息共享交换平台和金融信用信息基础数据库与个人征信机构,分别实现个人公共信用信息、个人征信信息的记录、归集、处理和应用。

II. Key Tasks

(1) Building mechanisms for personal creditworthiness education.

1. Forcefully carry forward a culture of creditworthiness. Put the construction of a culture of creditworthiness in a prominent position, cultivate and practice the socialist core values. Include citizen creditworthiness in citizen conventions, village rules and resident contracts, industry regulations, and so forth. Forcefully spread credit awareness, and have creditworthiness education run through the entire process of establishing citizen's morality and building a spiritual civilization. Strengthen education on social morality, professional ethics, family virtues, and personal morality, building a social atmosphere where "the trustworthy are proud, the untrustworthy are ashamed, and those without credit are concerned. 2. Carry out widespread publicity on creditworthiness. Take Spring Festival, International Consumer Rights Day, Labor Day, Children's Day, Online Credit Publicity Day, the National Day of Credit Concern, Credit Worthiness for Prosperity Publicity Month, National Day, National Constitution Day and National Legal Publicity Day, together with other important times and holidays and legally prescribed holidays, to thoroughly carry out special publicity activities on creditworthiness, concentrate publicity on credit policies and regulations, credit information, and type cases. Integrate China's traditional culture of creditworthiness with modern values, creating a series of artwork and public interest advertisements on creditworthiness that are diverse in subject matter and lively in presentation, films shot closely related to the people's lives and delightful for the masses, use rich media for creditworthiness publicity, increasing the frequency of creditworthiness publicity, and raising the level of creditworthiness publicity. Carry out special education and governance activities targeting key groups and individuals where creditworthiness is lacking or where there are pressing requirements for the establishment of creditworthiness. 3.积极选树推介诚信典型。 充分发挥媒体宣传引导作用,大力发掘、宣传有关部门和社会组织评选的信用状况良好的行政相对人、“守合同重信用”企业、诚信道德模范、A级纳税人、优秀青年志愿者、身边好人等诚信典型,通过“信用湖南”网站、政府网站等多种途径公示推介。 Organize all websites to carry out special topics on internet creditworthiness, regularly publicizing and promoting exemplars of creditworthiness, deeds of creditworthiness, to put forth a wave of high-quality online cultural projects, on the theme of creditworthiness, and strengthen using cases of online untrustworthiness as warning lessons. Support relevant departments and social organizations in recommending persons with no negative credit record to the public and exemplars of creditworthiness, and use the Provincial Credit Information Sharing and Exchange Platform to carry out cross-departmental and cross-field measures for the joint reward of trustworthiness. 4. Comprehensively strengthen creditworthiness education in schools. Increase content educational content on creditworthiness in basic, higher, vocational, and adult education, and other relevant courses. Further support schools of higher learning in establishing courses related to the establishment of a social credit system. Support schools of higher learning with the capacity in developing majors related to social credit administration. Promote schools to strengthen social credit administration, establishing and completing archives on the creditworthiness of students 18 years old or older, promoting making students' personal creditworthiness an important factor in considering their advancement, graduation, assessments and recognitions, issuance of scholarships, evaluations, recommendations and other such situations. Untrustworthy acts such as cheating on tests, academic fraud, not performing on financial assistance loans, or fabricating employment materials, are to be met with education, and the relevant information entered into their personal credit archive in accordance with laws and regulations. 5. Widely carry out credit education and training. Establish and complete systems for professional training and specialized evaluation in credit management. Formulate practice standards for credit service establishments and their practitioner staffs, increase the extent of training for those working in the credit industry. Encourage all types of social organizations and enterprises to construct credit management and education systems, Organize the drafting of texts on credit knowledge issued to government departments, market entities, schools, and the public, spreading credit knowledge. (2) Accelerate the establishment of personal creditworthiness records.

1. Implement personal real-name registration systems. With the citizen identification number system as a foundation, advance the establishment of a uniform social credit number system. Strengthen the collection and updating of resident identification information, promote efforts to register fingerprint information on resident identity cards, and bring about full coverage of citizens' uniform social credit numbers. Utilize information technology methods to continuously strengthen efforts to review personal identity information, ensuring uniqueness of personal identity distinguishing information. Follow laws and regulations to determine the scope of implementation for real-name identification systems, and fully implement the establishment of real-name registration systems using the healthcare, transportation, transportation of hazardous materials, internet, mail and couriers, telecommunications, financial accounts, employment and social security, and other such areas as the focus, so as to accurately collect personal creditworthiness records and create a foundation for joint rewards and punishments. Steadily advance connectivity between public security databases of basic population information and the Provincial Credit Information Sharing and Exchange Platform, making it so that personal identity information can be checked and compared online. 2. Establish personal creditworthiness records in key fields. The relevant departments should accelerate the establishment and improvement of mechanisms for forming and dynamically updating personal credit records , promptly aggregate credit information formed by relevant personnel in relevant activities and send it to the Provincial Credit Information Sharing and Exchange Platform to realize sharing and exchanges of personal public credit information with the focus on industries such as food and drugs, production safety, fire safety, traffic safety, environmental protection, biological security, product quality, tax collection, health care, labor security, engineering and construction, statistical data quality, financial services, intellectual property rights, judicial proceedings, e-commerce, volunteer service, research and education; and the principal targets being the officials, legally-designated representatives and the relevant responsible persons for public institutions and enterprises, lawyers, teachers, doctors, practicing pharmacists, appraisers, tax accountants, registered fire safety engineers, architects, cost supervisors, tenderers, construction technicians, accountant audit personnel, real estate agents, certified personnel, financial professionals, and tour guides and other professional groups. The Basic Financial Credit Information Databases and personal credit reporting establishments should vigorously develop personal credit reporting information aggregation and services in key fields. Encourage and guide industry associations, chambers of congress, and other such industry organizations in establishing and completing member credit archives, bringing about inter-connectivity with the Provincial Credit Information Sharing and Exchange Platform. (3) Improve the mechanisms for personal information security, privacy protection, and credit restoration.

1. Protect the security of personal information. 有关部门要严格按规定建立健全并严格执行个人信息记录、归集、共享、使用、安全保障等规章制度,明确个人信息查询使用权限和程序,建立完善个人信息查询使用登记和审查制度,做好数据库安全防护工作,防止信息泄露。 Strictly follow the relevant laws and regulations to increase the degree of oversight and management of the financial information basic database and credit reporting agencies, to ensure that personal credit reporting businesses are developed up to code, safeguard the lawful rights and interests of information entities, and ensure the security of state information. 2. Strengthening Protections of Privacy. Personal public credit information must not be collected except by authorization of laws and regulations. 加大对泄露、篡改、毁损、出售或非法向他人提供个人信息,以及非法窃取个人信息等行为的查处打击力度。 制定完善个人信息采集、提供、使用及隐私保护等方面的监管措施。 对金融机构、征信机构、互联网企业、大数据公司、互联网金融公司、移动应用程序开发企业实施重点监控。 (责任单位:省公安厅、省委网信办、省发改委、省工商局、省政府金融办、省通信管理局、人民银行长沙中心支行、湖南证监局、湖南银监局、湖南保监局等有关单位,2018年12月底前完成)

3. Establish mechanisms for restoring credit. 建立个人公共信用信息纠错、修复机制,制定异议处理、投诉、行政复议等管理制度及操作细则。 按照相关法律法规和国家关于行政许可和行政处罚等信用信息公示工作的有关部署,明确个人各类公共信用信息展示期限,不再展示和使用超过期限的公共信用信息。 畅通信用修复渠道,丰富信用修复方式,运用教育培训、强化指导等手段,支持有失信行为的个人通过事后主动履约、申请延期、自主解释等方式减少失信损失,通过按时履约、志愿服务、慈善捐助等方式修复信用,重塑诚信形象。 (责任单位:省社会信用体系建设领导小组成员单位按职责职能分工负责,持续实施)

(4) Standardizing the sharing and usage of personal creditworthiness information

1. Promote sharing of personal public credit information. 研究制定省级个人公共信用信息目录、分类标准和共享交换规范。 市州要制定本地区个人公共信用信息目录。 各级各有关部门要将归集的个人公共信用信息推送至省信用信息共享交换平台。 依托省信用信息共享交换平台,建立全省个人公共信用信息数据库,并逐步建立跨区域、跨部门、跨行业个人公共信用信息的互联、互通、互查机制。 (责任单位:省发改委、省公安厅、人民银行长沙中心支行、省质监局等有关单位,2018年12月底前完成)

2. Actively carry out personal Public Credit Information services. 各级各有关部门要依法依规建立完善个人公共信用信息查询使用登记和审查制度,明确个人信息查询使用权限和程序,及时向社会提供个人公共信用信息授权查询服务。 探索依据个人公共信用信息构建分类管理和诚信积分管理机制,鼓励支持有条件的地区将个人公共信用信息载入市民卡,打造“市民信用卡”。 推动建立省级个人公共信用信息数据库与金融信用信息基础数据库的共享关系,并向个人征信机构提供服务。 (责任单位:省发改委、人民银行长沙中心支行等有关单位,2018年12月底前完成)

(5) Improving the mechanism for rewarding personal trustworthiness and punishing untrustworthiness

1. Provide greater services and facilitation to those individuals with positive credit. 对有关部门和社会组织实施信用分类监管确定的信用状况良好的行政相对人、诚信道德模范、优秀志愿者,行业协会商会推荐的诚信会员,以及新闻媒体挖掘的诚信主体等建立优良信用记录,各级各有关部门要创新守信激励措施,在实施财政性资金项目安排、招商引资配套优惠政策等各类政府优惠扶持政策中,优先考虑诚信主体。 在教育、就业、创业、社会保障等重点领域率先实施对诚信个人给予重点支持和优先便利的具体措施。 各级行政审批部门依据权力清单和责任清单,办理行政许可等过程中,对具有优良信用记录的个人和连续三年以上无不良信用记录的行政相对人,可根据实际情况依法采取“绿色通道”和“容缺受理”等便利服务措施。 Encourage social establishments to lawfully use credit reporting products, and give preferential treatment and facilitation to individuals with good credit records, making it so that the trustworthy obtain greater opportunities and benefits in the marketplace. 2. Carry out joint disciplinary action against seriously untrustworthy persons in key industries . 各级各有关部门要制定本区域、本领域个人失信行为认定、等级划分和分类监管制度,对个人失信行为进行分类处理和评价。 各级社会信用体系建设牵头部门要汇总形成惩戒措施清单,作为有关方面实施联动惩戒的依据,并督促落实到位。 Employ joint disciplinary action measures in accordance with laws and regulations against personal acts of untrustworthiness such as those that seriously endanger the public's safety in their health and lives, those that seriously undermine the order of fair market competition and social justice, refusals to perform legally prescribed obligations seriously influencing judicial and administrative organs credibility, as well as refusals to perform national defense obligations. 将恶意逃废债务、骗取财政资金、行贿受贿、非法集资、电信诈骗、网络欺诈、金融欺诈、交通违法、不依法诚信纳税、骗取就业创业优惠政策和社会保险基金等严重失信个人列为重点监管对象,依法依规采取行政性约束和惩戒措施。 At the same time that joint disciplinary action is conducted against untrustworthy enterprises and public institutions, corresponding joint disciplinary action should be taken against the relevant responsible persons, in accordance with laws, regulations, and policies, and make joint disciplinary action reach down to the individual. 鼓励金融信用信息基础数据库和个人征信机构将采集的个人严重失信记录,推送至省公共信用信息共享服务平台,作为实施信用惩戒措施的参考。 (责任单位:省发改委、人民银行长沙中心支行、湖南银监局、湖南保监局、湖南证监局、省高级人民法院、省公安厅、省财政厅、省经信委、省委网信办、省交通运输厅、省国税局、省地税局等有关单位,持续实施)

3.推动形成市场性、社会性和行业性约束和惩戒。 各级各有关部门要建立健全个人严重失信行为披露、曝光与举报制度,依托政府门户网站和信用网站,依法依规向社会公开披露各级人民政府掌握的个人严重失信信息,并在“信用湖南”网站集中公开展示。 Encourage market entities to provide differentiated services to seriously untrustworthy individuals. III. Safeguard Measures

(1) Strengthen Organizational Leadership. 各级各有关部门要统筹规划,切实加强对个人诚信建设工作的组织领导,严格按照主要任务分工,研究出台具体落实方案,细化责任,明确完成时限,确保责任到人、工作到人、落实到人。 建立工作考核推进机制,定期进行督促、指导和检查,并委托第三方机构进行评估。 (责任单位:省发改委、人民银行长沙中心支行等有关单位,持续实施)

(二)强化规章制度。 依据国家信用法律法规,逐步建立和完善个人诚信体系建设法规制度,加强对个人信息安全和个人隐私的保护,有力维护个人信息的主体权利与合法权益,完善个人公共信用信息记录、归集、处理、查询和应用等各环节的规范制度,为个人诚信体系建设创造良好的法制环境。 (责任单位:省政府法制办、省发改委、人民银行长沙中心支行等有关单位,持续实施)

(三)加大资金支持。 各级各有关部门要加强社会信用体系建设的资金保障,对个人诚信体系建设组织工作、管理工作积极予以经费支持。 加大对个人公共信用信息数据库建设、信息应用、宣传教育和人才培训等各方面的资金支持力度,确保各项工作落实到位。 (责任单位:省发改委、人民银行长沙中心支行、省财政厅等有关单位,持续实施)
