Notification on Joint Disciplinary Action Against Judgment Defaulters in Bidding and Tendering Activities

为贯彻党的十八届三中、四中、五中全会精神,落实《中央政法委关于切实解决人民法院执行难问题的通知》(政法〔2005〕52号)、《国务院关于促进市场公平竞争维护市场正常秩序的若干意见》(国发〔2014〕20号)、《国务院关于印发社会信用体系建设规划纲要(2014—2020年)的通知》(国发〔2014〕21号)、《关于对失信被执行人实施联合惩戒的合作备忘录》(发改财金〔2016〕141号)要求,加快推进社会信用体系建设,健全跨部门失信联合惩戒机制,促进招标投标市场健康有序发展,现就在招标投标活动中对失信被执行人实施联合惩戒的有关事项通知如下。

一、充分认识在招标投标活动中实施联合惩戒的重要性

诚实信用是招标投标活动的基本原则之一。 在招标投标活动中对失信被执行人开展联合惩戒,有利于规范招标投标活动中当事人的行为,促进招标投标市场健康有序发展;有利于建立健全“一处失信,处处受限”的信用联合惩戒机制,推进社会信用体系建设;有利于维护司法权威,提升司法公信力,在全社会形成尊重司法,诚实守信的良好氛围。 各有关单位要进一步提高认识,在招标投标活动中对失信被执行人实施联合惩戒,有效应用失信被执行人信息,推动招标投标活动规范、高效、透明。

II. Targets of Joint Punishment

The targets of joint disciplinary action are the following persons when listed as judgment defaulters by the people's courts: bidders, tender agents, bid appraisal experts, and others engaged in bidding and tendering.

三、失信被执行人信息查询内容及方式

(一)查询内容

失信被执行人(法人或者其他组织)的名称、统一社会信用代码(或组织机构代码)、法定代表人或者负责人姓名;失信被执行人(自然人)的姓名、性别、年龄、身份证号码;生效法律文书确定的义务和被执行人的履行情况;失信被执行人失信行为的具体情形;执行依据的制作单位和文号、执行案号、立案时间、执行法院;人民法院认为应当记载和公布的不涉及国家秘密、商业秘密、个人隐私的其他事项。

(二)推送及查询方式

最高人民法院将失信被执行人信息推送到全国信用信息共享平台和“信用中国”网站,并负责及时更新。

招标人、招标代理机构、有关单位应当通过“信用中国”网站(www.creditchina.gov.cn)或各级信用信息共享平台查询相关主体是否为失信被执行人,并采取必要方式做好失信被执行人信息查询记录和证据留存。 投标人可通过“信用中国”网站查询相关主体是否为失信被执行人。

国家公共资源交易平台、中国招标投标公共服务平台、各省级信用信息共享平台通过全国信用信息共享平台共享失信被执行人信息,各省级公共资源交易平台通过国家公共资源交易平台共享失信被执行人信息,逐步实现失信被执行人信息推送、接收、查询、应用的自动化。

IV. Joint Punishment Measures

各相关部门应依据《中华人民共和国民事诉讼法》《中华人民共和国招标投标法》《中华人民共和国招标投标法实施条例》《最高人民法院关于公布失信被执行人名单信息的若干规定》等相关法律法规,依法对失信被执行人在招标投标活动中采取限制措施。

(1) Restrict judgment defaulters' bidding and tendering activities

In projects where bidding is required in accordance with law, the tenderers shall clearly provide for handling judgment defaulters and standards for bid evaluation in the prequalification announcement, the bid announcement, invitations to submit bids and pre-qualification documents, and bid documents; and during the period for bid appraisal the tenderer, tender agency body, bid appraisal experts committee shall inquire as to whether bidders are judgment defaulters, and restrict those who are judgment defaulters from the bidding activities in accordance with law.

Where two or more natural persons, legal persons, or other organizations form a collective and participate in bidding activities as a single bidder, an inquiry shall be made into information on whether each member of the collective is a judgment defaulters. Where one or more of the members of a collective is a judgment defaulter, the collective is to be viewed as a judgment defaulters.

(2) Restrict judgment defaulters' tender representation activities.

Where tenderers retain a tender agent to carry out the tendering activity, they shall inquire into information on whether they are judgment defaulters, and selection of tender agents with no record of untrustworthiness is encouraged.

(3) Restrict judgment defaulters' bid appraisal activities.

When units lawfully established for managing a pool of bid appraisal experts review hiring of bid appraisal experts and conduct routine management, they shall make inquiries regarding information on whether they are judgment defaulters, and not hire judgment defaulters to be bid appraisal experts. Where bid appraisal experts become judgment defaulters during the period of their employ, they shall be promptely removed.

(4) Restrict judgment defaulters' bidding and tendering operations activities.

Before tenderers or tender agents hire practitioners, they shall clearly provide measures for handling judgment defaulters, make inquiries into whether relevant persons are judgment defaulters, and should follow procedures to handle practitioners that are judgment defaulters.

The restrictions above are to conclude from the date on which the judgment defaulters are deleted from the Supreme People's Court judgment defaulter information base.

V. Work Requirements

(一)有关单位要根据本《通知》,共同推动在招标投标活动中对失信被执行人开展联合惩戒工作,指导、督促各地、各部门落实联合惩戒工作要求,确保联合惩戒工作规范有序进行。

(二)有关单位应在规范招标投标活动中,建立相关单位和个人违法失信行为信用记录,通过全国信用信息共享平台、国家公共资源交易平台和中国招标投标公共服务平台实现信用信息交换共享和动态更新,并按照有关规定及时在“信用中国”网站予以公开。

(三)有关单位应当妥善保管失信被执行人信息,不得用于招标投标以外的事项,不得泄露企业经营秘密和相关个人隐私。
