In order to carry out the spirit of the Guiding Opinion by the General Office of the State Council on Strengthening the Establishment of the Personal Creditworthiness System (Publication No. 98 of the General Office of the State Council) and the Plan for Strengthening the Establishment of Personal Creditworthiness System in Guangdong Province (Letter No. 442 of the Guangdong General Office) speed up the establishment of the Personal Creditworthiness System in Huizhou City, Guangdong Province, praise honesty and punish dishonesty, improve the credit level of the whole society, and create a good credit environment, this implementation plan was formulated.

I. General Requirements

(1) Guiding Thought

Fully implement the spirit of the Nineteenth National Congress of the Communist Party of China, guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, and deeply implement the spirit of General Secretary Xi Jinping's important directives and instructions to Guangdong, in accordance with the Party Central Committee and the State Council, for the drawing up of policies on the establishment of the Social Credit System, the Guangdong Provincial Committee, the provincial government, and the Huizhou Municipal Committee of Guangdong use the establishment of robust personal credit records as the foundation, explore the application of personal credit information, improve the credit joint reward and punishment mechanism, perfect personal information security, privacy protection, and credit repair, vigorously carry forward creditworthiness culture, and provide strong support for promoting the construction of a green modern landscape city in Huizhou.

(2) Main objectives

By the end of 2018, the collection and collation of personal and public credit information will be realized, the operation mechanism of credit information for key groups will be established, the joint mechanisms for incentivizing keeping faith and punishing breaking faith will be promoted, and the protection mechanism for the rights and interests of credit subjects will be basically sound. By the end of 2020, full coverage of personal credit information records will be promoted, the applications of credit information will be broadened, personal credit awareness will be improved, and an increasingly strong atmosphere of creditworthiness will be fostered.

II. Main tasks

(1) Establishing and perfecting personal credit records

1. Promote the improvement of personal real-name registration systems. With the citizen identification number system as a foundation, advance the establishment of a uniform social credit number system. In fields such as the internet, postal delivery, telecommunications, financial accounts, personnel assessment, employment and social insurance, health care, the real-name registration system should be implemented, and all relevant units should do a good job of maintaining the confidentiality of citizens’ identifying information that is protected by national law. 2. Perfect the personal credit record. Promote the establishment of the recordkeeping mechanism of the personal creditworthiness system in each industry and region by relying on the Huizhou Public Credit Information Management System; focusing on fields such as food and pharmaceuticals, workplace safety, fire safety, traffic safety, environmental protection, biosafety, product quality, tax payment, medical care, labor protections, engineering, financial services, intellectual property rights, judicial proceedings, electronic commerce, and volunteering; and targeting professional groups such as civil servants, legal representatives of enterprises and relevant responsible persons, lawyers, teachers, physicians, licensed pharmacists, assessors, taxpayers, registered fire engineers, accounting auditors, real estate intermediaries, certified auditors, financial practitioners, and tour guides. 3. Regulate and develop the credit-reporting market. Encourage basic financial credit information database and personal credit-reporting agencies to carry out collection and services involving the credit information of personnel in key fields and to create credit profiles for credit-reporting agencies and relevant personnel. Establish the sharing relationship between the personal public credit information and the basic financial credit information database and provide credit-reporting services to credit-reporting agencies for individuals according to the law. Support credit-reporting agencies for individuals in sharing legally collected seriously untrustworthy records during individuals’ activities in the market and the economy with credit information sharing platforms at the city, provincial, and national levels. (二)规范个人信用记录应用。

1.建立健全个人信用信息查询机制。 依托市公共信用信息管理系统,建立个人公共信用信息数据库,个人公共信用信息按权限进行管理,实施授权查询机制,并依法依规向社会提供个人公共信用信息授权查询服务。 (Leading unit: Municipal Development and Reform Commission; Responsible units: the related departments of the city, the People's Governments of each county and district, the Daya Bay Development Zone, and the Zhongkai High-tech Zone Management Committee)

2. Explore the usage of personal credit information in the management of government affairs. Explore mechanisms for the inquiry of personal credit information in the point-based hukou system for city residency, assessments of professional titles, appraisals for awards and honors, personnel examinations, selections and promotions of cadres, entries into special industries, selections of directors of enterprises, and the distribution of public rental housing as a necessary step and important reference in the handling of everyday administrative management. 3. Develop scenarios for the use of personal credit information. Promote the implementation of “Action Plan for the Joint Rewards of Trustworthiness and the Promotion of a Credit System for Huizhou Volunteers.” Cooperate with social organizations, and research and develop scenarios for the use of personal credit information such as book borrowing and rewards for star volunteers. (三)完善个人信用联合奖惩机制。

1.积极推动联合激励。 出台对具有优良信用记录的个人在教育、社会服务等领域给予重点支持的政策措施。 在办理行政许可、行政确认、行政备案、补助申请、税收减免等过程中,对具有优良信用记录的个人和连续三年以上无不良信用记录的行政相对人,可根据实际情况依法采取“绿色通道”和“容缺受理”等便利服务措施。 (Leading unit: Municipal Development and Reform Commission; Responsible units: the related departments of the city, the People's Governments of each county and district, the Daya Bay Development Zone, and the Zhongkai High-tech Zone Management Committee)

2. Carry out joint disciplinary action against seriously untrustworthy persons in key industries . 依法依规对以下四类严重失信行为的个人采取联合行政性惩戒措施:一是在食品药品、生态环境、国土资源、工程质量、安全生产、交通违法、消防安全、产品质量等领域严重危害人民群众身体健康和生命安全的行为。 二是贿赂、逃税骗税、恶意逃废债务、恶意拖欠货款或服务费、恶意欠薪、非法集资、网络电信诈骗、合同欺诈、公益诈骗、传销、无证照经营、制售假冒伪劣产品和故意侵犯知识产权、出借和借用资质投标、围标串标、虚假广告、侵害消费者或证券期货投资者合法权益、严重破坏网络空间传播秩序、聚众扰乱社会秩序、在国家考试中组织作弊或向他人提供作弊器材、伪造证明材料骗保等严重破坏市场公平竞争秩序和社会正常秩序的行为。 三是当事人在司法机关、行政机关作出判决或决定后,有履行能力但拒不履行或不按要求履行法定义务,严重影响司法机关、行政机关公信力的行为。 Fourth is refusal to perform national defense obligations, such as refusing or avoiding military service, refusing or delaying the expropriation of civil-use resources or impeding the modification of expropriated civil-use resources, endangering national defense interests or destroying national defense facilities. (四)保护个人信用信息权益。

1. Protect the security of personal information. 加强个人信用信息数据库建设和安全防护。 建立健全个人信息查询管理办法,规范信息查询、使用、审查等活动。 (牵头单位:市发展改革局、经济和信息化局;责任单位:市各有关部门,各县、区人民政府,大亚湾开发区、仲恺高新区管委会)

2. Strengthening Protections of Privacy. 重点监控金融机构、征信机构、互联网企业、大数据公司、移动应用程序开发企业,严厉查处泄露、篡改、毁损、出售或者非法向他人提供个人信息等行为。 (牵头单位:市网信办、公安局、商务局、金融工作局,人民银行惠州市中心支行,惠州银监分局;责任单位:市各有关部门,各县、区人民政府,大亚湾开发区、仲恺高新区管委会)

3. Establish mechanisms for restoring credit. 按照国家统一部署,建立个人公共信用信息纠错、修复机制,制定异议处理等有关办理规程。 (牵头单位:市发展改革局,人民银行惠州市中心支行;责任单位:市各有关部门,各县、区人民政府,大亚湾开发区、仲恺高新区管委会)

(五)加强个人诚信宣传教育。

  1. 大力弘扬诚信文化。将诚信教育贯穿公民道德建设和精神文明创建全过程,推行公民诚信守则。充分发挥媒体舆论宣传引导作用,大力发掘、宣传有关部门和社会组织评选的诚信道德模范、优秀志愿者等诚信典型。 (牵头单位:市委宣传部;责任单位:市各有关部门,各县、区人民政府,大亚湾开发区、仲恺高新区管委会)
  2. 集中宣传诚信政策知识。结合春节、信用记录关爱日、国际消费者权益日、诚信兴商宣传月等重要时间节点和纪念日集中宣传信用政策法规、信用知识。(牵头单位:市发展改革局、商务局、工商局,人民银行惠州市中心支行)
  3. 加强诚信教育培训。将诚信教育作为中小学和高校学生思想品德教育的重要内容,探索建立18岁以上成年学生诚信档案。以公务员、金融机构负责人、企事业单位管理者等为重点,广泛深入开展诚信教育培训。 Encourage all types of social organizations and enterprises to construct credit management and education systems, Organize the writing of primers on credit knowledge and rely on all kinds of community (village) basic level organization to spread credit information to the public. III. Organization Safeguards

(1) Strengthen organizational leadership. 各地、各部门要高度重视个人诚信体系建设工作,明确建设任务和时间节点,细化责任分工和具体措施,全面做好本地区、本部门个人诚信体系建设工作。 市社会信用体系建设统筹协调小组办公室要积极协调解决个人诚信体系建设的重点、难点问题,推动各地、各有关部门加强协同配合,形成合力。

(2) Accelerate system construction. 各地、各部门要加快推进个人诚信管理制度建设,依法依规加强本地区、本部门对个人公共信用信息的记录、管理、报送和应用,开展信用联合奖惩,以及完善个人信用档案资料保密机制、信用修复和异议投诉处理等方面的制度建设,提升个人诚信体系建设制度化水平。
