Anhui Provincial Implementation Plan for Strengthening the Establishment of the Personal Creditworthiness System


This implementation Plan is drafted so as to implement the spirit of the "Guiding Opinion by the General Office of the State Council on Strengthening the Establishment of the Personal Creditworthiness System" (Guobanfa (2016) No. 98) , to acclerate the advancement of the establishment of Anhui Province's personal creditworthiness system, and to raise the whole society's awareness of creditworthiness and credit levels.

I. General Requirements

Fully put in place the spirit of the 18th Party Congress and it's 3rd, 4th, 5th, and 6th plenary sessions; thoroughly implement the spirit of General Secretary Xi Jinping's series of important talks, especially his important talk when inspecting Anhui; follow the decisions and deployment of the Province's 10th Party delegate confrence to take the core socialist values as the root in education and practice from which to vigorously promote a culture of creditworthiness; persist in the principles of government taking the lead and society jointly builiding, completing a legal system, regulated development and comprehensive advancement with breakthroughs in key areas, strengthening use, and joint punishments and rewards; carry forward a culture of creditworthiness, accelerating the establishment of personal records of creditworthiness, establishing personal Public Credit Information databases, improve systems of rules and regulatory standards for personal information security, privacy protections, and credit restoration; complete mechanisms for rewarding trustworthiness and for joint disciplinary action against untrustworthiness that cross regions, departments, and fields' , letting creditworthiness become the value commonly pursued by the entire society and code of conduct, actively creating a positive social environment where "trustworthiness is honored and trustworthiness is shameful", so as to provide support for the coordination, establishment and creation of an open sharing and beautiful Anhui.

II. Strengthening the education on personal creditworthiness

(1) Vigorously promote a culture of creditworthiness. Put the construction of a culture of creditworthiness in a prominent position, cultivate and practice the socialist core values. Include citizen creditworthiness in citizen conventions, village rules and resident contracts, industry regulations, and so forth. Forcefully spread credit awareness, and have creditworthiness education run through the entire process of establishing citizen's morality and building a spiritual civilization. Forcefully advocate the concepts of the culture of creditworthiness, "creditworthiness, sincerity, trustworthiness, and accountability". Establish and use good person pavilions, forcefully publicizing those who have turned themselves around, moral models and creditworthy businesses; select and introduce examples of creditworthiness, giving the entire society role models to follow and goals to pursue. Strengthen education on social morality, professional ethics, family virtues, and personal morality, building a social atmosphere where "the trustworthy are proud, the untrustworthy are ashamed, and those without credit are concerned. (2) Carry out widespread publicity on creditworthiness. Take Spring Festival, Labor Day, Children's Day, National Day, Credit Worthiness for Prosperity Publicity Month, Quality month, Production Safety Month, Creditworthiness Assistance Publicity Month, Credit Reporting Publicity Month, Creditworthy Activities Week, International Consumer Rights Day, Online Creditworthiness Publicity Day, the National Day of Credit Concern, Credit Consumerism for All Day, National Constitution Day and National Legal Publicity Day, together with other important times and holidays and legally prescribed holidays, to thoroughly carry out creditworthiness themed publicity activities, concentrate publicity on credit policies and regulations, credit information, and type cases. Integrate China's traditional culture of creditworthiness with modern values, creating a series of artwork and public interest advertisements on creditworthiness that are diverse in subject matter and lively in presentation, films shot closely related to the people's lives and delightful for the masses, use rich media for creditworthiness publicity, increasing the frequency of creditworthiness publicity, and raising the level of creditworthiness publicity. Carry out special education and governance activities targeting key groups and individuals where creditworthiness is lacking or where there are pressing requirements for the establishment of creditworthiness. (3) Comprehensively carry out creditworthiness education and training. Increase content educational content on creditworthiness in basic, higher, vocational, and adult education, and other relevant courses. Support schools of higher learning with the capacity in developing majors related to social credit administration. Rely on the school registration system to collect Public Credit Information during their enrollment, establishing and completing archives on the creditworthiness of adult students 18 years old or older by the end of June 2018, and making students' personal creditworthiness an important measure in their advancement, graduation, assessments and recognitions, issuance of scholarships, evaluations, recommendations and other such situations. Untrustworthy acts such as cheating on tests, academic fraud, not performing on promises to return financial assistance loans, or fabricating employment materials, are to be met with education and punishment, and the relevant information entered into their personal credit archive in accordance with laws and regulations. Implement systems for credit management professional training and assessment, and formulate practice standards for credit service establishments and their practitioner staffs by the end of 2017 Encourage all types of social organizations and enterprises to construct credit management and education systems, Organize the drafting of texts and story picture books on credit knowledge issued to government departments, market entities, schools, and the public, spreading credit knowledge . (4) Actively choose and establish exemplars of creditworthiness. Give full play to the role of media in publicity and guiding public opinion, vigorously uncovering and publicizing examples of creditworthiness as selected by relevant departments and social organizations such as administrative counterparts with positive credit situations, 'businesses that 'follow contracts and value credit', and creditworthy models of morality. Organize all websites to carry out special topics on internet creditworthiness, regularly publicizing and promoting exemplars of creditworthiness, deeds of creditworthiness, to put forth a wave of high-quality online cultural projects, on the theme of creditworthiness, and strengthen using cases of online untrustworthiness as warning lessons. Each relevant department and social organizations should establish a system for selecting and recommending examples of creditworthiness, periodically providing society with those with no negative credit record and with examples of creditworthiness, relying on the provincial Public Credit Information sharing platform to share Public Credit Information, and promote joint incentive measures for trustworthiness that cross-departments, cross- fields. III. Accelerating the establishment of personal creditworthiness records

(1) Implement personal real-name registration systems. In accordance with the national deployment, put in place a uniform social credit number system with the citizen identification number system as its foundation. Strengthen the collection and updating of resident identification information, promote efforts to register fingerprint information on resident identity cards, and bring about full coverage of citizens' uniform social credit numbers. Regulate the use of identification information, strengthening sharing of basic personal information. Utilize information technology methods to continuously strengthen efforts to review personal identity information, ensuring uniqueness of personal identity distinguishing information. Follow laws and regulations to determine the scope of implementation for real-name identification systems, and fully implement the establishment of real-name registration systems using the healthcare, transportation, transportation of hazardous materials, internet, mail and couriers, telecommunications, financial accounts, employment and social security, and other such areas as the focus, so as to accurately collect personal creditworthiness records and create a foundation for joint rewards and punishments. Before the end of June 2018, make it so that the the provincial basic population information archive is connected with the the provincial Public Credit Information sharing service platform, strengthening sharing of basic identity information. (2) Establish personal creditworthiness records in key fields. The relevant departments should accelerate the establishment and improvement of mechanisms for forming personal credit records, promptly summarize creditworthiness information formed by relevant personnel in relevant activities, to ensure that information is truthful and accurate, and bring about prompt and dynamic updates with the focus on industries such as food and drugs, production safety, circulation services, intermediary services, exhibitions and advertising, public resource trading, education and research, travel businesses, internet applications and services, fire safety, traffic safety, environmental protection, biological security, product quality, tax collection, health care, labor security, engineering and construction projects, financial services, intellectual property rights, judicial proceedings, e-commerce; and the principal targets being officials, legally-designated representatives and the relevant responsible persons for enterprises, lawyers, teachers, doctors, practicing pharmacists, appraisers, tax accountants, registered fire safety engineers, environmental protection impact assessment professionals, accountant audit personnel, personnel with registered credentials for residential urban-rural development, asset appraisers, real estate agents, certification professionals, scientific researchers, insurance operators, financial professionals, statistics professionals, news media practitioners,and tour guides and other professional groups; and before the end of 2017, each relevant department is to establish and improve mechanisms for forming and dynamically updating personal credit records, promptly collecting Public Credit Information formed in social activities, and sending it to the provincial Public Credit Information sharing service platform, bringing about exchanges and sharing of Public Credit Information. The Basic Financial Credit Information Databases and personal credit reporting establishments should vigorously develop personal credit reporting information aggregation and services in key fields. Encourage and lead industry associations, chambers of congress, and other such industry organizations in establishing and completing member credit archives, and send relevant information to the provincial Public Credit Information sharing service platforms. IV. Improving the mechanisms for personal information security, privacy protection, and credit repair

(1) Protect the security of personal information. Before the end of 2017, each area and relevant department is to establish, complete, and strictly implement systems for recording, aggregating, exchanging, using, and ensuring the security of personal information, clarifying the management process and requirements for personal information in all stages, and doing a good job of database defense efforts, preventing information leaks. Strictly follow the relevant laws and regulations to increase the degree of both onsite and offsite supervision and management of units using the Basic Financial Credit Information Databases and credit reporting agencies, to ensure that personal credit reporting businesses are developed up to code, safeguard the lawful rights and interests of information entities, and ensure the security of state information. Before the end of June 2018, Establish credit archives for credit reporting establishments and there relevant personnel, and a 'blacklist' system for business violating rules. (2) Strengthen privacy protections. Personal public credit information must not be collected except by authorization of laws and regulations. Increase the extent of investigation and handling of acts such as the disclosure, alteration, destruction, sale or illegal provision to other of personal information, as well as illegal stealing of personal information. Before the end of 2018, draft monitoring measures improving the collection, provision, use, and privacy protect for personal information, and implement key monitoring for financial establishments, credit reporting establishments, Internet enterprises, Big Data Companies, Internet finance companies, and mobile applications developers. (3) Establish mechanisms for restoring credit. Before the end of 2017, establish mechanisms for the correction and restoration of personal public credit information, draft operational implementation regulations for management systems such as handling objections, complaints, and administrative reconsideration. Follow relevant laws and regulations and state deployments relating to announcement of administrative permits, administrative punishments and other credit information, clarifying the period for display of each type of Public Credit Information, and that Public Credit Information is not to be displayed again or displayed beyond the prescribed time. Clear channels for the restoration of credit, enrich the methods for credit restoration, use tactics such as education, training and strengthing guidance to support individuals who have untrustworthy conduct to restore credit and create a new credit image through methods such as active performance of obligations, applications for extensions, and providing explanations, to reduce the harm from breaking trust, and methods such as on time performance of obligations, volunteer service, and charitable donations. V. Standardizing the sharing and usage of personal creditworthiness information

(1) Promote sharing of personal public credit information. Before the end of 2017, draft a provincial personal Public Credit Information catalog, with each relevant department following the directory's requirements to send Public Credit Information in their hands to the Provincial Public Credit Information sharing service platform. Before the end of June 2018, each municipality is to draft a personal Public Credit Information catalog for that city, and sending personal Public Credit Information that is collected to the provincial Public Credit Information sharing and exchange platform; before the end of 2018, draft standards for categorizing and regulating the exchange and sharing of personal Public Credit Information, relying on the provincial Public Credit Information sharing service platform to establish an individual Public Credit Information database, and gradually establishing mechanisms for interconnections, intercommunication, and mutally checking Public Credit Information that cross regions, departments, and industries. (2) Actively develop personal public credit information services. Before the end of 2017, each area and relevant department is to follow the laws and regulations to establish and improve systems for registered use and review of inquiries into personal information, clarifying the authority and procedures for inquiries into personal information, to promptly provide society with authorized public credit information inquiry services in accordance with laws and regulations. Explore management mechanisms based on connecting categorical management of Public Credit Information and creditworthiness credits, encourage and support areas with the capacity in including personal Public Credit Information residents' creditworthiness in citizen cards, creating a 'citizen credit card'. Promote the establishment of relationships for sharing between provincial level Public Credit Information databases and Basic Financial Credit Information Databases, and provide services to personal credit reporting establishments. VI. Improving the mechanism for rewarding personal trustworthiness and punishing untrustworthiness

(1) Provide greater services and conveniences to individuals with good credit. Establish good credit records for administrative counterparts with good credit circumstances, models of creditworthiness and morality, and exceptional volunteers that are identified through relevant departments and social organizations' implementation of categorical credit management; creditworthy members recommended by industry associations and chambers of commerce; as well as and creditworthy entities uncovered by news media; be put up as exemplars of creditworthiness and so forth; relevant departments of all areas should innovate incentive measures for trustworthiness and before the end of June 2017, preferentially implement specific measures giving key support and priority facilitation to creditworthy individuals in education, employment, opening businesses, social security, and other key fields. (2) Carry out joint disciplinary action for individuals in key industries with serious untrustworthy conduct. By June 2017, each relevant department should draft systems for designating untrustworthy personal conduct, delineating levels, and categorical oversight and management, to conduct categorical handling and rating of individual untrustworthy conduct in that field. By the end of 2017, all levels of departments leading the establishment of the social credit system should report aggregate and form and a list of punishment measures, as a basis for joint punitive action in all areas. Employ joint disciplinary action measures in accordance with laws and regulations against personal acts of untrustworthiness such as those that seriously endanger the public's safety in their health and lives, those that seriously undermine the order of fair market competition and social justice, refusals to perform legally prescribed obligations seriously influencing judicial and administrative organs credibility, as well as refusals to perform national defense obligations. List seriously untrustworthy individuals as targets for key scrutiny, such as those who maliciously avoid debt, gain assets and funds through fraud, give or accept bribes, illegally fundraise, conduct telecom fraud, conduct internet fraud, conduct financial fraud, have traffic violations, do not lawfully and honestly pay taxes, or who obtain employment and entrepreneurship benefits and social security funds through fraud, and lawfully employ administrative restrictions and punishment measures against them. Support credit reporting establishments in collecting information on seriously untrustworthy conduct, including it in credit records and reports, and sending it to the Provincial Public Credit Information Services Platform. VII. Strengthening safeguard measures
