"China's Action Plan to Combat Human Trafficking (2021-2030)" (hereafter referred to as "Action Plan") is drafted on the basis of relevant international conventions and PRC domestic laws in order to actively respond to the serious situation of human trafficking crimes at home and abroad, effectively prevent and combat human trafficking crimes in accordance with the law, actively assist and properly resettle trafficked victims, promote the physical and psychological recovery of trafficked victims and return them to their families and society, and earnestly safeguard citizens' legitimate rights and interests.
I. Guiding Ideology and Overall Goals
(1) Guiding Thought.
With Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era as guidance, persist in the work directives of "being people-centered, comprehensive governance, emphasizing prevention, and combining prevention with the struggle' and form a work structure in which the Party committee guidance, government responsibility, joint action by departments, social coordination, citizen participation, legal safeguards, and technical support, to continuously advance the state governance system and the modernization of governance capacity, improving systems, completing mechanisms, implementing responsibility, integrating resources, addressing symptoms and causes, effectively preventing and punishing trafficking crimes, to truly safeguard citizens' basic rights, and social harmony and stability as well as national security, and present the image of a responsible power.
(2) Overall Goals
Adhere to and improve long-term and effective mechanisms for countering human trafficking that integrate prevention, enforcement, aid, placement, and rehabilitation; complete mechanisms for coordination, cooperation, and ensuring efforts to combat trafficking; advance work models for a legal, coordinated, technological, and whole of society struggle against trafficking; continuously increase the level to which the struggle is brought under law, coordinated, applies technology, and involves civil society, to form an overall structure for combatting trafficking that matches the social development. Clean the online cyberspace ecology and effectively guard against and combat the use of networks in trafficking and other new forms of crime. Refine and implement every action measure, effectively prevent and resolutely combat trafficking crimes, ensure that trafficked persons promptly receive aid and rehabilitation and appropriate placements, and assist victims of trafficking in successfully returning to their families and re-entering society.
II. Operational Measures and Division of Responsibilities
(1) Complete crime prevention mechanisms.
1. Work objectives.
Strengthen governance at the source, improving the socially-based prevention network for human trafficking crimes and carrying out grid management to build a group prevention and corrections system that coordinates multiple departments and in which society broadly participates. Comprehensively punish human trafficking activities in key areas and "buyer's markets" and strictly combat the use of networks to carry out human trafficking, to effectively prevent the occurrences of human trafficking
2. Action measures.
(1) Deepen interdepartmental joint action, implementing connectivity of information and work, comprehensively using big data, artificial intelligence, and other modern technological methods as well as traditional methods such as home visits and mass work, to continuously improve work mechanisms for the discovery and reporting of trafficking crimes. Improve efforts to prevent trafficking crimes in key industries, venues, and regions for trafficking activities, and among key populations. Highlight the "place" and "face" impacts of crime prevention work. --Strengthen management of the human resource market, regulating labor demand, employer recruitment, and occupational intermediary activities, and promoting occupation intermediary bodies, employers, labor dispatch units and contracting units to carry out efforts to give training and education on trafficking, and to prevent it. Clear channels for investigating reports and complaints regarding labor safeguards, strengthen investigations and law enforcement on labor safeguards, improve mechanisms for coordinated joint action, clean up illegal occupational intermediary markets, and strictly combat illegal acts of using child labor. Strengthen the force of investigation and handling of illegal conduct such as the illegal use of persons with mental disabilities, intellectual disabilities, or foreigners who do not have residence permits for labor. Oversee all types of online platforms in improving mechanisms for active screening, identification, filtering, and reporting of negative and illegal information content, strictly implementing the real-name management system for social media accounts. Strictly combat the use of networks to produce, reproduce, publish, sell, or transmit obscene content or to carry out illegal and criminal conduct such as sexual harassment or sexual assault of minors. (3) Increase the force of corrections for "buyers markets" for trafficking crimes, using modern technological methods to strengthen analysis and assessment of 'buyers' markets’, carrying out comprehensive governance and special actions in areas where the purchase of persons occurs more regularly, punishing crimes by purchasers in accordance with law, to reduce trafficking at its source. Strengthen inspections at ports and management of border crossings, making systems for inspecting persons crossing borders more strict, increasing the extent of inspections for foreigners illegally entering, residing, or working in the nation; strengthen oversight of the human resources market in border areas, strictly regulating cooperative business activities for foreign labor, clean up and rectify the market for international marriage matchmaking, and lawfully shut down illegal international marriage matchmaking establishments. Strengthen cooperation between governments and regional governance to prevent transnational trafficking crimes, continuously enrich multilateral and bilateral mechanisms for preventing transnational trafficking crimes with other nations and territories. . (5) Strengthen the use of information technologies in the prevention of trafficking crimes, improve the "internet + Counter-trafficking" work model, and promote the use of modern technologies in efforts to prevent trafficking. (2) Fight crime and rescue victims of trafficking.
1. Work objectives.
Maintain a high-pressure status at all times in the fight against trafficking crimes, to forcefully deter and punish trafficking crimes. Increase the use of technology in the investigation of trafficking crimes, advancing upgrades for modernization of investigative tactics. Continuously increase the capacity and level for the quick discovery and investigation of trafficking cases, combat trafficking crimes in strict accordance with law, punishing offenders, and promptly aiding the victims of trafficking.
2. Action measures.
(1) Continue to organize and carry out special actions on combatting trafficking crimes throughout the nation, further improve counter-trafficking mechanisms in which the public security organs lead the way, relevant departments assist, society cooperates, and public widely participates; establish and complete a uniform counter-trafficking network integrating both the "online" and "offline". Strictly combat the use of networks platforms to carry out trafficking. establish and complete comprehensive governance systems for cybercrimes and violations, carry out strict management of online platforms such as for social media and chat, information publication, and service intermediaries; oversee online platforms performance of primary responsibility for managing the information ecosystem, and implement online protections for minors; children's personal information must not be illegally collected, used, or disclosed. Improve systems for online complaints and reports, periodically carry out 'clean web' actions, clean up online platforms used to publish information related to the illegal adoption, trafficking of women and children, sexually assaulting minors, and so forth, promptly discover leads on related crimes, and strictly combat the use of networks to perpetrate trafficking crimes. Local public security organs are responsible for collecting blood samples from the parents of missing children, testing them and recording them in the DNA (deoxyribonucleic acid) database for combatting trafficking, and increasing communication with relevant departments, to promptly discover children whose identity is unknown or who are suspected of having been trafficked, and entering their blood tests into the pool. Where children whose identities are unknown are settled, a blood test is to be made and entered and compared with the database, as a strict requirement for the settlement of children. Strictly combat illegal fake paternity testing conducted by forensic evaluation establishments and other organizations or individuals. -- Resolutely and lawfully punish those who commit crimes such as organizing, compelling, or inducing prostitution, as well as those who produce, sell, or transmit pornographic items. (4) Rescue trafficked children in accordance with law, and return them to their birth parents. For rescued children whose parents or other guardians cannot be located, the public security organs are to provide relevant materials to the civil affairs departments to make an appropriate placement; families that purchased the children must not continue to raise them. III. Safeguard Measures
(1) Strengthen Organizational Coordination. The Inter-ministerial Joint Conference of the State Council on Countering Trafficking is to strengthen organizational leadership and overall coordination, formulate and improve policy measures, and promptly study and resolve outstanding problems and challenges. The general office of the inter-ministerial joint conference is responsible for coordinating and organizing oversight and inspections of the implementation of the Action Plan, carrying out periodic and final assessments, and establishing a supervisor and warning system for key cases and areas for countering trafficking. Local governments at the county level and above should gradually establish coordination mechanisms to organize and coordinate, guide and inspect counter-trafficking work, and draft local detailed implementation rules for the Action Plan and annual implementation plans. Member units of all levels of counter-trafficking mechanisms at all levels should closely cooperate, draft implementation plans for that department or unit on the basis of the tasks and division of labor, and carry out self-inspections and assessments.
