Article 1: These measures are drafted on the basis of national laws, regulations, and relevant provisions, in accordance with the requirements of the State Council's "Regulations on the Administration of Credit Reporting Operations", the "Guiding Opinions on Strengthening the Establishment of Credit in the Transport and Travel Field" by the National Development and Reform Commission and four other departments (Fagaiyunxing (2017) No.10) and so forth, so as to advance the establishment of a railway credit system, advocate trustworthy conduct; to standardize the recording, use , and management of rail passengers credit information, and better preserve the order of rail stations and cars.
Article 2: These measures apply to the China Railways Corporation (hereinafter railway corporation), and each Railway Bureau.
Article 3: The railway corporation is primarily responsible for:
(1) Implementing and enforcing state laws and regulations on the establishment of a credit system, drafting a system of rules for managing railway passengers' credit information and organizing their implementation, and guiding and supervising the railway corporations' efforts on managing railway passenger credit information;
(2) Organizing, implementing and preserving uses of railway passenger credit information and organize training;
(3) In conjunction with other relevant national departments, establishing mechanisms for linking railway passenger credit information.
Article 4: Railway bureaus are primarily responsible for:
(1) implementing the provisions of the railway corporation, establishing and completing that unit's specific measures for the management of railway passengers credit records;
(2) Organizing passenger stations to complete recording, entry and review or railway passenger credit information and the collection, storage, usage, preservation, and destruction of relevant materials and other such management work;
(3) Reviewing that units' passenger credit information records, producing railway passenger credit information records;
(4) Overseeing and inspecting passenger station's efforts to manage railway passenger credit information;
(5) In conjunction with other local government departments, establishing mechanisms for linking railway passenger credit information.
Article 5: Passenger Stations are primarily responsible for:
(1) Organize staff at the position to accurately record information on passengers' untrustworthy conduct in accordance with provisions, collecting and properly storing relevant materials;
(2) promptly and accurately recording railway passenger credit information and conducting an initial review;
(3) promptly handling objections to passenger credit information, and giving feedback on the outcome of the review;
Article 6: The following untrustworthy conduct is to be included in railway passengers' credit information record management:
(1) Disrupting the order of railway transport at stations or on cars and endangering railway security, causing serious negative social impact;
(2) Smoking on EMU trains or smoking in the areas of other trains where smoking is prohibitted;
(3) Investigated scalping of tickets and making or selling of counterfeit tickets;
(4) Falsely using discount (benefit) identification documents, or using forged or invalid discount (benefit) identification documents, to purchase tickets for travel;
(5) Using forged, expired, or other invalid tickets, or falsely using replacements for lost tickets, to travel;
(6) Riding without a ticket, exceeding your station (seat) and refusing to supplement the fare;
(7) conduct that should be given administrative punishment in accordance with relevant laws and regulations.
Article 7: When encountering the circumstances listed in article 6, station and car staff should follow provisions to promptly address it and give clear information on the basis for the disposition and any consequences such as supplementing transport costs, additional ticket costs, or entry into railway credit management; accurately complete a passenger record indicating information such as the passenger's name, effective identification type and number, residential address, contact information, date of travel, car number, interval, and the untrustworthy conduct, and have the station or train staff and the passenger themself sign it; when passengers refuse to sign this it is to be noted, and the entire process is to be documented through audio-video recording and the video monitor system records. At the same time, materials such as relevant tickets/receipts, identify information and photographs, written records, and a/v recordings are to be collected.
Stations and cars shall promptly notify railway public security departments in accordance with regulations, to handle those who violate rules by charging through ticket checks, security checks, entrances, and exits, and may lawfully pursue them for civil liability.
Article 8: Passenger stations should enter passenger records completed by staff and relevant information materials into the passenger management information system daily, and after review by the responsible parties, send it up to the Railway Bureaus. The time period for railway passenger credit information records is usually 5 years from the day on which the conduct occurred; where five years is exceeded, they shall be deleted.
Article 9: The time period for railway passenger credit information records is usually 5 years from the day on which the conduct occurred; where five years is exceeded, they shall be deleted. Where the State has other provisions on the relevant period, follow those provisions.
Article 10: Where during the period for recording railway passenger credit information, passengers feel that their credit information has errors or ommissions, they should go through the 12306 customer service line, or have the station they go through the 12306 customer service line, to submit an objection to the station that collected the information, and the station should conduct an investigation and handle it within 20 days of receiving the objection, and respond to the passenger with the outcome in writing. Where upon investigation it is confirmed that there are errors or omissions in the passenger credit information that need to be corrected or deleted, within 5 days, the railways bureau department for passengers shall make the corrections or deletions following review and approval, and the railways bureau is to report to the Corporation transport bureau.
Article 11: The railways bureaus shall use multiple methods such as hanging notices in stations, digital screens, radio and the 12306 website, and Wechat platforms, to publicize laws and regulations related to passenger transport as well as provisions on the management of passenger credit information record, calling on passengers to be honest and trustworthy, to follow rules and obey law, and to consciously preserve order in passenger railway transport.
Article 12: Railways bureaus should do a good job of alloting, using, and maintaining equipment and facilities such as a/v recorders, surveillance monitor systems, and the railway passenger management information system, to ensure they function well.
Article 13: The railway corporation, in conjunction with the member units of the national inter-ministerial conference on the establishment of a social credit system, is to establish systems such as for the provision, use, revision, and deletion of railway passenger credit information, periodically report on railway passenger credit information, and provide railway passenger credit information to relevant departments and credit reporting establishments as provided.
The railway bureaus are to actively participate in local government establishment of credit systems, establish mechanisms such as for the provision, use, revision, and deletion of railway passenger credit informatino, periodically report on railway passenger credit information, and provide railway passenger credit information to relevant departments and credit reporting establishments as provided.
Article 14: The railways corporation and railways bureaus' passenger departments shall promptly understand relevant credit reporting establishment and departments' use and maintenance of railway passenger credit information. Where they discover that railway passenger credit information is not promptly maintained or is improperly used, they should request that this be promptly rectified; and where it causes harm or serious consequences for passengers, they may stop providing railway passenger credit information to them in accordance with provisions, and pursue the legal responsibility as provided.
Article 15: Where the process of examination and review provided for in articles 7 and 10 has not been followed, railway passenger credit information and related materials must not be revised, deleted or destroyed by any unit or individual.
Railway passenger credit information and related materials must not be sent, published, or leaked to other units and individuals by any units or individuals.
Where the provisions of the preceding paragraph are violated, strictly pursue their responsibility, and when it involves violations or crimes, transfer it to the judicial organs in accordance with law.
Article 16: The railways corporation is responsible for the interpretation of these Measures.
Article 17: These measures take effect from their date of issue.
