为深入贯彻党的十八大和十八届三中、四中、五中、六中全会精神,落实《国务院关于促进市场公平竞争维护市场正常秩序的若干意见》(国发〔2014〕20号)、《国务院关于印发社会信用体系建设规划纲要(2014—2020年)的通知》(国发〔2014〕21号)、《国务院关于建立完善守信联合激励和失信联合惩戒制度加快推进社会诚信建设的指导意见》(国发〔2016〕33号)等文件精神及“褒扬诚信、惩戒失信”的总体要求,着眼于弘扬和践行社会主义核心价值观,国家发展改革委、人民银行、交通运输部、中央宣传部、中央编办、中央文明办、中央网信办、最高人民法院、工业和信息化部、公安部、财政部、人力资源社会保障部、国土资源部、环境保护部、住房城乡建设部、水利部、商务部、文化部、国资委、海关总署、税务总局、工商总局、质检总局、安全监管总局、食品药品监管总局、林业局、旅游局、法制办、银监会、保监会、外汇局、全国总工会、共青团中央、全国妇联、全国工商联、铁路总公司等部门就针对严重违法失信超限超载运输车辆相关责任主体实施联合惩戒措施达成如下一致意见:
I. The targets of joint disciplinary action
The targets of joint disciplinary action are entities responsible for serious unlawful and untrustworthy exceeding of limits and overloading transport, as published by the Ministry of Transport on the basis of "The General Office of the Ministry of Transport Notice on Designation of Seriously Unlawful and Untrustworthy Conduct Exceeding of Limits and Overloading and Matters Related to the Responsible Entities" (JaobanGonglu (2017) No. 8) and relevant laws, regulations, rules, and normative documents (hereinafter simply "untustworthy parties"). Including: Freight transport source units and road transport enterprises as well as their legal representatives, principle responsible persons, and relevant personnel with direct responsibility; and freight vehicles and freight vehicle drivers. The targets for joint disciplinary action described above are to be periodically summarized by the Ministry of Transport and provided to department signatories of this MOU.
II. Joint Punishment Measures
各部门依照有关法律、法规、规章及规范性文件的规定,对联合惩戒对象采取下列一种或多种惩戒措施(相关依据和实施部门见附录)。
(一)限制或禁止失信当事人的市场准入、行政许可。
1.依法严格道路运输市场准入。
对失信当事人进入道路运输市场依法实行限制性管理措施。 Implemented by the Ministry of Transport.
2.限制企业经营的审慎性参考。
Take measures such as cancelling untrustworthy parties' qualifications to work in the transport industry and related business, or restricting business operations. 将失信状况作为失信当事人重新从事营业性运输审批的审慎性参考依据。 由交通运输部等有关市场监管部门实施。
3. Lawful restrictions on obtaining production permits.
Lawfully restrict untrustworthy parties applications for industrial production permits. Implemented by the State Quality Inspection Administration.
4. Lawfully restrictions on participation in government purchasing activities.
Assist in inquiries regarding government procurement projects; lawfully restricting untrustworthy parties' participation in government procurement activities for a certain period of time. 由财政部实施。
5. Restrictions on acquisition of Government Land Provisions.
Conduct necessary restrictions of untrustworthy parties applications to use land or participate in bidding on land. Implemented by the Ministry of Land and Natural Resources.
6. Lawfully restricting participation in project bidding.
Lawfully restrict untrustworthy parties from participation in government purchasing activities for a set period of time. 由国家发展改革委、交通运输部、工业和信息化部、住房城乡建设部、水利部等有关部门按职责分工实施。
7. Lawfully restricting receipt of production safety permits.
Lawfully restrict untrustworthy parties applications for production safety permits. To be implemented by departments such as the Bureau of Safety Supervision and Ministry of Housing and Urban and Rural Development.
8.供新增项目核准时审慎性参考。
为失信当事人新增项目的核准提供审慎性参考。 由国家发展改革委、交通运输部、工业和信息化部、质检总局等有关部门实施。
(2) Strengthening routine supervision of untrustworthy parties, and restricting financing and spending.
9.加强货车生产和改装监管。
对失信当事人从事货车生产、改装等经营活动加强审查和监督检查,对失信当事人加强道路查纠。 由工业和信息化部、质检总局、公安部、交通运输部、国家发展改革委实施。
10.加强重点货源单位监管。
对煤炭、钢材、水泥、砂石、商品车等货物集散地以及货运站等场所的经营人、管理人进行排查,加强上述重点货运源头单位货物装载工作的监督检查,杜绝超限超载车辆上路行驶。 由交通运输部和各有关部门实施。
11.在重要路段和节点加强对失信当事人的监管。
在货运运输主通道、重要桥梁入口、高速公路入口处等重要路段和节点,加强对失信当事人超限超载情况的重点监测,禁止超限超载违法运输车辆进入高速公路和上桥行驶。 由交通运输部、公安部实施。
12.供驾驶证审验换发时参考。
将失信当事人违法超限超载的记分情况,作为其驾驶证通过审验和换发的重要参考。 由公安部实施。
13.加强安全生产监管。
Make untrustworthy parties targets for key supervision, increase the extent of routine supervision, increase the rate and frequency of spot checks. Establish mechanisms for normalizing unannounced site inspections, irregularly carrying out spot checks. 每半年至少进行1次抽查,每年至少约谈1次其主要负责人;发现有新的安全生产违法行为的,要依法依规从重处罚。 由交通运输部、工业和信息化部、安全监管总局等有关部门实施。
14.供保险费率厘定时审慎性参考。
将失信当事人的失信记录作为办理超限超载车辆运输保险业务及厘定相关费率的参考,对其采取提高费率、实行最高费率或增加风险费率、附加条款等措施。 由保监会实施。
15.供金融机构融资授信时审慎性参考。
将失信当事人的失信记录作为金融机构对失信当事人融资授信的参考,进行必要限制。 由人民银行、银监会实施。
16.从严审核企业债券发行。
对失信当事人申请发行企业债券,从严予以审核。 由国家发展改革委实施。
17. Restrictions on some high-spending.
对违反超限超载相关法律法规,被交通运输管理部门给予行政处罚,并被交通运输管理部门申请人民法院强制执行的失信当事人,未按执行通知书指定的期间履行《行政处罚决定书》确定的给付义务的,由人民法院依法将其纳入失信被执行人名单,并向有关部门推送,限制其高消费行为,包括限制乘坐飞机、列车软卧、G字头动车组列车、其他动车组列车一等座等其他非生活和工作必需的消费行为。 由最高人民法院、交通运输部、铁路总公司、旅游局、公安部、文化部等有关部门实施。
18. Public Announcement.
失信当事人信息通过“信用中国”网站和国家企业信用信息公示系统向社会公布;通过主要新闻网站向社会公布有关信息。 由国家发展改革委、工商总局、中央网信办实施。
(三)限制失信当事人享受优惠政策、评优表彰和相关任职。
19. Restriction on obtaining government subsidies and social security funding supports in accordance with laws and regulations.
依法依规限制失信当事人申请政府补贴性资金和社会保障资金支持。 由财政部、国家发展改革委、人力资源社会保障部、国资委等有关部门实施。
20.限制失信当事人享受优惠性政策的审慎性参考。
在实施投资、运输绿色通道等相关优惠性政策时,将失信状况作为限制失信当事人享受该政策的审慎性参考。 由国家发展改革委、税务总局、商务部、交通运输部、质检总局等有关部门实施。
21.供纳税信用管理时审慎性参考。
In managing tax credit of untrustworthy parties, lawfully make their untrustworthy status a prudential consideration and basis in the collection and assessment of their credit information. 由税务总局实施。
22.限制失信当事人成为海关认证企业。
对已经在海关注册并申请适用海关认证企业管理的,不予通过认证;已经成为认证企业的,按照规定下调企业信用等级。 由海关总署实施。
23.禁止参评文明单位、道德模范。
禁止失信当事人参评文明单位。 对失信当事人不得授予道德模范、五一劳动奖章等荣誉称号,已获得荣誉称号的予以撤销。 由中央宣传部、中央文明办、全国总工会、共青团中央、全国妇联实施。
24.限制在事业单位的相关任职。
限制失信当事人担任事业单位法定代表人。 由中央编办实施。
25.限制在生产经营单位的相关任职。
Lawfully restrict untrustworthy parties from serving as the principle responsible person, directors, supervisors, or senior management at production and business units, and where they are already in such a position, follow procedures to request a change. 由工商总局、质检总局、安全监管总局等有关部门按职责分工实施。
26. Other Measures
相关市场监管部门和社会组织在获得荣誉、从业任职资格、资质审核等方面将失信当事人的失信状况作为审慎性参考依据。 To be implemented by each relevant department.
III. Implementation Methods for Information Sharing and Joint Disciplinary Action
The Ministry of Transport is to go through the national credit information sharing platform to provide information provided by relevant departments on untrustworthy parties to the other unit signatories to this memorandum, and follow relevant provisions to actively update it. 同时依法在交通运输部政府网站、“信用交通”网站、“信用中国”网站、国家企业信用信息公示系统等向社会公布。
各部门按照本备忘录约定内容,依法依规对失信当事人实施联合惩戒。 同时,建立惩戒效果定期通报机制,各部门根据实际情况定期将联合惩戒实施情况通过全国信用信息共享平台联合惩戒子系统反馈至国家发展改革委和交通运输部。
IV. Sustained Management of Joint Disciplinary Action
失信当事人信息自公布之日起满2年的,从交通运输部门公布栏中撤出,相关失信记录在后台予以保存。 在规定期限内纠正失信行为、消除不良影响的,不再作为联合惩戒的对象,交通运输部门应及时通知有关部门。 On the basis of their legally-prescribed duties, relevant departments are to carry out punishments or lift punishments, in accordance with laws, regulations or relevant provisions.
交通运输部执行失信联合惩戒措施时,主动发现、经市场主体提出异议申请或投诉发现信息不实的,应及时核实并反馈。 Information that is found to be incorrect upon verification should be promptly corrected or withdrawn.
V. Other matters
Each department shall closely coordinate and actively implement this memorandum, drafting detailed implementation rules and operational processes on how to use, revoke, and manage information on untrustworthiness, and guiding all levels of units in corresponding system to carry out joint disciplinary action in accordance with law. The Ministry of Transport is responsible for the collection and sharing of information related to untrustworthy parties.
Specific issues in the implementation of this memorandum of cooperation related to the coordination and cooperation between departments are to be settled by the departments through consultations.
After this memorandum is signed, where any laws, regulations, rules or normative documents that are the basis for any joint punishment measure are revised or adjusted, the revised laws, regulations, rules or normative documents are controlling.
