"Criminal Law of the People's Republic of China Amendment (10) was passed at the 30th meeting of the Standing Committee of the 12th National People's Congress on November 4, 2017, and is hereby released, to take effect on the date of promulgation.

So as to punish and correct criminal conduct insulting the national anthem and to effectively protect the solemnity of performances and uses of the national anthem and the national dignity, a new paragraph is added as the second paragraph of Criminal Law article 299, amending it to read:
"Where the national flag or national emblem of the PRC is insulted in a public place by methods such as burning, destroying, scribbling, soiling, or trampling, it is to be to be sentenced to up to three years imprisonment, short-term detention, controlled release, or deprivation of political rights."
"Where, in a public place, the lyrics or score of the national anthem of the PRC are intentionally altered, the national anthem is performed in a distorted or derogatory manner, or the national anthem is insulted through other means, and the circumstances are serious, it is to be punished in accordance with the preceding paragraph. "
This Amendment takes effect on the date of promulgation.
