Measures for Performance Industry Self-discipline and Management of Performers (Provisional)

Chapter I: GeneralProvisions

Article 1: 为不断提高演出行业演艺人员(以下简称“演艺人员”)职业素质,规范演艺人员从业行为,加强演艺人员从业自律管理,树立演艺人员良好职业形象,促进演出行业健康发展,中国演出行业协会根据《营业性演出管理条例》《营业性演出管理条例实施细则》等有关法规规定,制定本办法。

Article 2: 本办法所称演艺人员是指在中国境内从事音乐、戏剧、舞蹈、曲艺、杂技以及其他形式的现场文艺演出活动的表演者。

Article 3: 演艺人员应当自觉遵守本办法第二章所规定的从业规范相关条款(以下简称“从业规范”)。

从业规范由中国演出行业协会根据国家有关法律、法规,结合演艺人员为维护行业和个人形象应当遵从的社会公德、职业道德、家庭美德、个人品德等职业要求制定,并在行业范围内监督实施。

Article 4: 本办法所称从业范围包括但不限于:

(一)演出场所经营单位、文艺表演团体、演出经纪机构等中国演出行业协会会员策划、组织、参与的各类演出活动,以及与之相关的宣传、推介、营销、赞助、表彰、奖励等活动;

(二)网络表演经营单位等中国演出行业协会会员所属平台、媒体等策划、组织、开展的直播、录播活动,以及与之相关的宣传、推介、营销、赞助、表彰、奖励等活动;

(三)其他与中国演出行业协会密切相关的行业组织、社会机构组织开展的各类活动。

Article 5: 演艺人员违反从业规范,由中国演出行业协会根据本办法,在其从业范围内实施自律惩戒措施。

Article 6: 对演艺人员违反从业规范实施自律惩戒措施,应当遵循客观公正、公开透明、公平审慎的原则,坚持教育与惩戒相结合,违规情节与惩戒措施相适应,以事实为依据,依法依规开展工作。

Chapter II: Practice Norms

Article 7: Performers shall have the necessary cultural sophistication, specialized knowledge, and professional skills to engage in theatrical performance work, and shall comply with the following requirements:

(一)热爱祖国,拥护党的路线方针政策,自觉遵守国家法律法规,遵守文化、演出行业有关规定,自觉接受政府相关管理部门监管和社会监督;

(二)坚持文艺为人民服务、为社会主义服务的方向,自觉践行社会主义核心价值观,弘扬主旋律,壮大正能量,做有信仰、有情怀、有担当的新时代文艺工作者;

(三)热爱文艺事业,恪守艺术品格,维护中华文化立场,弘扬中华美学精神,坚守文艺审美理想,严肃认真对待创作表演,努力提升艺术质量,拒绝用是非不辩、低级庸俗、粗制滥造的作品或宣传误导观众;

(四)遵守社会公德,言语文明,礼貌待人,立正守身,以身作则,注重陶冶品德,加强道德修养,珍视和维护个人职业声誉,积极树立正面形象;

(五)坚守契约精神,依法依约履行经纪合同、代言合同、演出合同等各类合同;

(六)尊重合作团队与合作对象,尊重编剧、导演、舞美、服化道等各部门的艺术创作,尊重全体演职人员的共同劳动,积极配合合作团队合理的工作需求;

(七)遵守与著作权相关的法律法规,树立和强化著作权保护意识,维护著作权人合法权益;

(八)积极参与社会公益活动,助力公益事业发展,自觉践行社会责任;

(九)配合社会各界共同引导未成年人树立正确的价值观念,自觉抵制扰乱社会秩序、恶意攻击他人等不文明行为;

(十)依法依规应当遵守的其他要求。

Article 8: Performers must not exhibit the following behaviors:

(1) Violating the basic principles established by the Constitution; endangering national unity, sovereignty, or territorial integrity; endangering national security, or harming the nation's honor and interests;

(2) Inciting ethnic hatred or ethnic discrimination; infringing on ethnic customs and habits, hurting ethnic feelings, and undermining ethnic unity;

(3) Violating the state's religious policies or promoting cults and superstitions;

(4) Organizing, participating in, and publicizing illegal activities involving obscenity, pornography, gambling, drugs, violence, terror, or underworld forces;

(5) Disrupting public order as a result of drunk driving, driving without a license, fleeing the scene of an accident, malicious provocation, and so forth, causing vile social impact;

(6) Jeapordizing social mores or harming the exceptional ethnic cultural traditions;

(7) Tricking the audiences of for-profit performances by means such as fake singing or faking performances, or to attract the audience by performances that violate ethics and morals or public order and good customs;

(8) terrifying or cruel methods of performance, or using physical defects, the display of physical abnormalities, or other such methods to draw crowds;

(9) Maliciously violating or not performing on a contract through methods such as fraud or concealment; cancelling performances or not performing on a contract for reasons other than Force Majeure, or modifying the content of performances that has already been reviewed and approved without authorization;

(10) Violating laws and regulations or public order and good custom by publishing improper speech that distorts historical facts or insults or defames heroes and martyrs; or publish false information, inciting others to disrupt public order, and impacting social stability;

(11) Harming others' reputation or other lawful rights and interests by means such as insult or defamation;

(12) Violating laws and regulations related to advertising endorsements, or tricking or misleading consumers through false advertising or methods that cause misconceptions;

(13) Seeking benefit through improper methods such as violating confidentiality agreement or forging and altering materials, or using the profession to facilitate the solicitation of improper benefits;

(14) Other circumstances violating ethics and morals or public order and good customs that cause a serious negative social impact;

(15) Other situations expressly prohibited by laws and administrative regulations.

Article 9: 演出场所经营单位、文艺表演团体、演出经纪机构或者演出经纪人员应当积极引导所属演艺人员遵守从业规范,依法依规从业。

 

Chapter III: Work Bodies

Article 10: 中国演出行业协会设立道德建设委员会,具体承担演艺人员道德建设和从业自律等相关工作。

道德建设委员会为非法人分支机构,在中国演出行业协会领导下开展工作。

Article 11: 道德建设委员会委员由下列人员构成:

(一)演出场所经营单位、文艺表演团体、演出经纪机构等的管理人员代表;

(2) Representatives of performers;

(三)网络表演(直播)经营单位管理人员代表;

(四)共青团中央、全国妇女联合会、中国关心下一代工作委员会等群团组织代表或者其推荐的专家代表;

(5) News media representatives;

(六)从事演艺行业法律事务的律师代表;

(7) Representatives of other related industries.

根据工作需要,道德建设委员会可以聘请相关领域专家担任顾问。

Article 12: 道德建设委员会委员由中国演出行业协会驻会机构提名或者相关组织推荐,征询本人意见后,形成委员候选人名单,经常务理事会表决决定,由中国演出行业协会聘任。

Article 13: 道德建设委员会委员应当履行以下义务:

(一)遵守道德建设委员会章程;

(二)履行委员职责,完成分配或指定的工作;

(三)遵纪守法,公正廉洁,不得徇私舞弊、玩忽职守、索贿受贿等;

(四)严守工作纪律,不得泄露或擅自披露履行职责过程中了解的信息;

(五)遵守其他相关规定。

Article 14: 道德建设委员会设立秘书处作为日常办事机构。秘书处设在中国演出行业协会驻会机构内,负责材料收集、会议组织及联络协调等相关工作。

 

Chapter IV: Procedures

Article 15: Based on the outcome of the appraisal by the Commission on Moral Construction, the China Association of Performing Arts is to oversee and guide member units to carry out the following penalty measures against performers who violate industry norms as part of industry self-discipline:

(1) Conduct criticism and education;

(2) Revoke qualifications to participate in all types of industry competitions, commendations, awards, and funding;

(3) Based on the severity of the circumstances of performers violations of industry norms, carry out 1-year, 3-year, 5-year, or permanent collective industry boycotts;

(4) Coordinate with other industry associations to carry out joint penalties across industries.

The measures above may be carried out independently or together.

Article 16: 中国演出行业协会各会员单位或者个人不得邀请、组织处于联合抵制期内的演艺人员参与演出行业各类活动,也不得为其提供其他宣传、推介等便利。

Article 17: 道德建设委员会发现演艺人员涉嫌违反从业规范的,应当从行政管理部门、行业组织、成员单位及其他第三方渠道收集信息,并对演艺人员及其所属单位提供的申辩材料进行评估后,提出具体处理意见,经中国演出行业协会审议通过后报送文化和旅游部,并以书面通知向相关单位及个人通报。

Article 18: 受到联合抵制的演艺人员需要继续从事演出活动的,本人或者其所属单位应当在联合抵制期限届满前3个月内向道德建设委员会提出申请,经道德建设委员会综合评议后,给予是否同意复出的意见。

对符合复出条件的演艺人员,由中国演出行业协会向会员单位和个人通报,取消联合抵制措施,并监督引导其参与行业培训、职业教育、公益项目等活动,改善社会形象。

Article 19: 道德建设委员会委员有下列情形之一的,应当自行回避,当事人有权用口头或者书面方式申请回避:

(一)系被调查演艺人员近亲属;

(二)与被调查演艺人员存在利害关系;

(三)其他可能影响公正履行职责的情形。

Article 20: 道德建设委员会委员违反本办法第六条、第十三条、第十九条规定的,由中国演出行业协会取消其委员资格。

Chapter V: Supplemental Provisions

Article 21: 道德建设委员会依据本办法制定工作章程,并报中国演出行业协会备案。

Article 22: 本办法由中国演出行业协会负责解释,自2021年3月1日起试行。
