为认真贯彻落实习近平总书记关于统筹推进新冠肺炎疫情防控和经济社会发展工作的重要指示精神,充分发挥政法机关职能作用,依法全力做好新冠肺炎疫情防控工作、保障疫情防控期间复工复产工作,制定如下意见。

I. Thoroughly study General Secretary Xi Jinping's important directives to truly strengthen political consciousness on lawfully ensuring the return to work and production. 以习近平同志为核心的党中央高度重视新冠肺炎疫情防控工作,习近平总书记多次发表重要讲话、作出重要指示,为统筹推进新冠肺炎疫情防控和经济社会发展工作提供了根本遵循。 各级政法机关和广大政法干警要深入学习贯彻习近平总书记重要指示精神,切实把思想和行动统一到党中央决策部署上来,增强“四个意识”,坚定“四个自信”,做到“两个维护”,在统筹推进疫情防控和经济社会发展工作中,勇当先锋,敢打头阵,全力以赴做好疫情防控、保障复工复产工作,及时解决群众所急所忧所思所盼。 按照分区分级精准复工复产的工作部署要求,统筹处理好疫情防控和经济社会发展的关系,在坚决做好疫情防控工作的同时,依法保障有序复工复产,为疫情防控提供有力物资保障,依法平等保护各类市场主体合法权益,为保持我国经济社会良好发展势头、实现决胜全面建成小康社会、决战脱贫攻坚的目标任务提供有力支撑。 要找准工作结合点和着力点,及时协调帮助解决复工复产中存在的困难和问题,切实防止复工复产后发生疫情感染,推动建立最严格的岗位责任制,完善疫情发生后的应急处理机制,为稳定社会预期、维持正常经济社会秩序,提供优质高效的政法公共服务和坚强有力的执法司法保障。

Promote the introduction of "Regulations on Guaranteeing Payments for Small and Medium-sized Enterprises", to improve systems related to restrictions and punishments for payment arrears, and to safeguard the lawful rights and interests of small and medium-sized enterprises. 密切配合有关部门出台复工复产、扩大内需、维护企业和职工合法权益方面的政策规定,主动介入、提前研究,注重维护企业和职工的合法权益。 严格禁止在法律法规外增加许可事项、增设许可条件,防止设置过高门槛限制和影响复工复产。 加快对有关政策措施的合法性审查,在审查过程中注意平衡好各方权利义务,确保实现稳就业、稳投资的政策效果,为依法防控疫情、有序复工复产,特别是进一步做好复工复产后的防疫指导监督、建立最严格的岗位责任制和疫情应急处理机制提供法治支持。 Strengthen the study of laws and policies related to the prevention and control of the epidemic and to safeguarding enterprises' return to work and protection.

Reasonably use administrative discretion, prevent excessive and crude law enforcement that give rise to social conflicts, truly protecting the lawful rights and interests of enterprises and staff. 对具备复工复产条件、已建立严格防疫岗位责任制和疫情应急处理机制的企业,要积极为其申请增产、转产、开展科研攻关等相关行政许可提供方便、创造条件,简化工作流程。 认真做好道路交通保障工作,打通人流、物流堵点,在保障疫情防控车辆优先通行的同时,针对企业复工复产交通流量、货运物流回升的实际,不断科学优化交通管控,全力保障公路路网安全顺畅运行,确保员工回得来、原料供得上、产品出得去,解决好生活必需品供应的“最后一公里”问题。 扎实做好主干公路保顺畅保安全工作,减少群众等候时间。 对交通运输部门组织的集中运送农民工等群体返岗复工直通车,要加强沿途安全保障。 要强化货运驾驶人警示教育,严格货车安全技术状况检查,严防货车肇事引发事故。 加强海上治安和安全保卫工作,严厉打击海上违法犯罪活动,依法切实做好海上交通保障工作。

Correctly understand the delineation of laws and directives, creating a positive judicial environment. 对于疫情防控期间,超出经营范围生产经营疫情防控产品、商品,或因疫情防控需要,为赶工期导致产品标注不符合相关规定,生产销售的产品经鉴定符合国家相关卫生、质量标准,未造成实质危害的,依法妥善处理。 对于因生产经营需要,提前复工复产,引发新型冠状病毒传播或有传播风险的,要根据企业是否依法采取有关疫情防控措施,是否建立严格的岗位责任制,综合认定行为性质,依法妥善处理。 在涉企业案件办理中,积极推进认罪认罚从宽制度适用,落实少捕慎诉司法理念。 贯彻实施外商投资法及配套法规、相关司法解释,依法审理外商投资纠纷案件,稳妥认定外商投资合同效力。

VI. Prudently use compulsory measures such as arrest and the sealing or freezing of assets. 办理涉企业案件,能够采取较为轻缓、宽和措施的,尽量不采用限制人身、财产权利的强制性措施。 需要查封、扣押、冻结的,一般应当预留必要的流动资金和往来账户;对于涉案企业正在投入生产运营和正在用于科技创新、产品研发的设备、资金和技术资料等,原则上依法不予查封、扣押、冻结,确需提取犯罪证据的,可以采取拍照、复制、现场勘验等方式提取。 对有自首、立功表现,积极认罪悔罪,没有社会危险性的经营者,可依法不采取羁押强制措施。 对处于侦查、起诉和审判阶段在押的企业经营者,及时开展羁押必要性审查,对于变更强制措施不影响诉讼顺利进行,没有继续羁押必要的,依法及时变更强制措施。 对羁押中需要处理企业紧急事务的,应根据案件办理情况尽量允许其通过适当方式处理。

VIII. Do a good job of efforts to screen and investigate conflicts and disputes. 完善矛盾纠纷源头预防、排查预警、多元化解机制,及时发现各类风险隐患,坚持抓早抓小、应调尽调,灵活运用法理情相结合等方式,及时有效化解疫情防控中出现的苗头性、趋势性问题。 要主动做好心理疏导,引导全社会关心关爱确诊人员、隔离人员和病人家属。 建立健全多层次、多类型的调解组织网络,重点在矛盾纠纷多发的制造、餐饮、建筑、商贸服务以及民营高科技等行业和开发区、工业园区等区域加大调解组织资源配置,引导企业和职工主动选择、自愿接受调解服务。 加强人民调解、行政调解、行业性专业性调解、仲裁调解、司法调解的衔接联动,实现资源整合和信息共享。 鼓励律师、专家学者、法律工作者以及退休的法官、检察官、人力资源社会保障和工会工作人员、劳动人事争议仲裁员等社会力量参与调解工作,有条件的可以设立调解工作室,为企业和职工提供便捷高效的调解服务。

IX. Lawfully perform procuratorate oversight duties. 对于企业认为公安机关不应当立案而立案或应当立案而未立案,向人民检察院提出的,人民检察院应当受理、审查并依法处理。 对于公安机关违反有关规定查封、扣押、冻结涉案财物的,依法提出纠正意见。 加强涉疫情防控民事执行检察监督,对影响企业复工复产、损害企业和职工合法权益的违法执行活动,及时建议有关部门立即纠正。 加强对涉企业行政非诉执行案件的监督,对确有错误的裁定或行政决定提出检察建议予以纠正。 对疫情防控相关公益诉讼案件,特别是涉口罩、防护服等重要医疗防护物资产品生产经营者的,要准确把握法律监督与保障复工复产并重的原则,积极延伸办案职能作用,企业生产经营因案面临实际困难的,大力协调帮助解决。

Where electronic measures such as 'online handling' or 'mobile handling' can be used, employ 'non-contact' methods for handling as much as possible. 充分发挥公证监督证明、证据保全的职能优势,对因疫情影响、申请办理不可抗力事件、用于免责的商事声明等公证事项的企业,及时开辟绿色通道,帮助企业减少损失。 支持引导公证机构主动为涉疫重点企业减免公证服务费用。 仲裁机构、司法鉴定机构对受疫情影响较严重企业的案件优先受理、快速办理,引导仲裁机构、司法鉴定机构支持困难企业,对确因疫情造成服务费用缴付困难的企业实行缓缴服务费用。 积极引导当事人通过网上立案、诉讼、调解、信访,就近跨域立案,跨区域远程办理诉讼事项,最大限度减少人员出行、流动,防止诉讼当事人和信访群众在诉讼服务中心等场所聚集,最大限度维护人民群众生命健康权益。

XI. Accelerate the handling of administrative reconsideration cases involving enterprises and employment. 各级行政复议机构要切实加强复工复产过程中相关行政复议案件的受理和审理工作。 涉及复工复产企业的行政处罚、行政许可、行政征用、行政强制措施,以及涉及企业职工的工伤认定、社会保险费征收等行政执法行为引发行政争议的,各级行政复议机构要及时受理企业和职工的行政复议申请,积极运用调解、和解等方式依法稳妥化解相关争议,严格纠正违法或不当的行政执法行为,尽快定分止争,切实维护企业和职工合法权益,为企业复工复产提供坚实法治保障。

XII. Actively organize lawyers to provide professional legal services. 各地司法行政机关、律师协会要引导、组织律师事务所和律师积极开展疫情依法防控工作,为企业复工复产,以及建立最严格的岗位责任制、完善疫情应急处理机制提供专业法律服务。 发挥各地疫情防控法律服务团和党政机关法律顾问、公职律师作用,为相关部门制定企业复工复产政策措施、出台有关防疫指导、监督方面的规范性文件提供法律意见,当好法治参谋和助手。 发挥企业法律顾问和公司律师作用,为企业复工复产经营决策、防控疫情提供法律意见,依法办理诉讼、仲裁等法律事务,妥善处理各类法律纠纷。 组织专业律师针对企业复工复产过程中多发的物业租赁、劳动争议、工资社保、工伤赔偿等合同纠纷、债权债务法律问题加强研究,提出风险防控意见和建议,编印法律实务工作指南。 鼓励律师事务所对经营暂时陷入困难、现金流紧张的法律顾问单位和其他企业,酌情减免或缓收法律服务费用。

XIII. Strengthen publicity and education on the rule of law, and legal information services. 加强法治宣传,坚持在法治轨道上统筹推进疫情防控和企业复工复产工作。 落实“谁执法谁普法”普法责任制,以传染病防治法、劳动法等相关法律法规为重点,针对企业复工复产中出现的法律问题进行宣传解读,加强以案普法,促进企业恢复生产,保障企业合法权益,加强疫情防控、保护职工劳动权益。 充分发挥中国法律服务网、“12348”公共法律服务热线、公共法律服务中心等平台作用,做好复工复产政策解读与相关法律法规宣传普及,抽调专业力量组成法律服务团,提供全业务、全时空的法律服务。
