The General Office of the National Development and Reform Commission's Notice on Delivery and Application of the Results of Comprehensive Public Credit Appraisals of Market Entities

To the Development and Reform Commissions of each province, autonomous region, and directly governed municipality, and of the Xinjiang Production and Construction Corps; the Beijing Bureau of Economics and Information; the Hebei Office for the Administration of Government Affairs and Services;the Gilin Bureau for the Administration of Government Affairs and Services and Digital Establishment; the Heilongjiang Bureau for the Oversight of the Establishment of the Business Environment; and the National Public Credit Information Center:

So as to implement the requirements of documents such as the "Guiding Opinion by the General Office of the State Council on Accellerating the Advancement of the Establishment of the Social Credit System with New Forms of Credit-based Regulation Mechanisms"(GuoBanfa(2019) No. 35), to establish and complete mechanisms for comprehensive public credit appraisals, and use the comprehensive public credit appraisals in support of hierarchical and categorical regulation, our commission the National Public Credit Information Center and other relvenant big data establishments to carry out the first comprehensive public credit appraisals of 33,000,000 market entities, and hereby send the appraisal outcomes to you, and give the following notice on matters of fully using comprehensive public credit appraisal results and promoting the implementation of new forms of credit-based regulation mechanisms.

I. Include Appraisal Results in Local Credit Information Platforms for Management as Shared Information

The National Public Credit Information Center is requested to deliver the results of all market entities' comprehensive public credit appraisals to each provincial credit information sharing platform, and the receiving channels are to be the "ggxypj" path of provincial front-end processors. Provincial departments leading the establishment of the social credit system construction lead department are requested to take responsibility for making the appraisal results as an important part of market entities' credit information, including them in the local provincial credit information platform, and delivering them to the relevant affiliated departments and to all levels of credit information platform in the jurisdiction.

II. Make Appraisal Results the Fundamental Basis for Hierarchical and Categorical Regulation

Each level of department leading the establishment of the social credit system should urge relevant departments to make national level comprehensive public credit appraisal outcomes the fundamental basis for each industry and field's carrying out of hierarchical and categorical regulation; organically combining them with industry credit appraisal, local comprehensive public credit appraisal, and market credit appraisal results, to carry out differentiated regulatory measures on the basis of credit levels and categories. The National level comprehensive public credit appraisal is to serve as the fundamental basis, and is not to replace the carrying out of local comprehensive public credit appraisals and industry credit appraisals. Regions that have already carried of local comprehensive public credit appraisals and industry credit appraisals should plan use of multiple levels of appraisal results. Regions that have not yet carried out local comprehensive public credit appraisals should urge relevant departments to directly apply national comprehensive public credit information appraisal results in carrying out hierarchical and categorical management.

III. Extensively Listen to the Opinions and Suggestions of Market Entities on the Comprehensive Public Credit Appraisals

As the comprehensive public credit appraisals are still in the initiation and improvement phase, all levels of department leading the establishment of the social credit system should open channels for market entities to give feedback on the comprehensive public credit appraisals, and through methods such as convening symposiums and opening online column, should broadly collect the comments of market entities on the results of their own appraisals and the scope and method of their use. Each provincial level department leading the establishment of the social credit system is to clean up and compile the relevant comments and suggestions, and reflect these to the finance department of our Commission and to the National Public Credit Information Center.

IV. Encourage Exploration and Improvement of Local and Industry Credit Appraisals

In accordance with the spirit of the "Guiding Opinion by the General Office of the State Council on Accelerating the Advancement of the Establishment of the Social Credit System with New Forms of Credit-based Regulatory Mechanisms" (GuoBanFa (2019) No.35) , encourage the relevant departments of local governments to combine the region's actual social and economic conditions with the key challenges in market regulation, and bravely explore the development of comprehensive local public credit appraisals and industry credit appraisals. Regions that already carry out related work should optimize their index systems and appraisal models in a targeted fashion, to formulate improved methods for comprehensive public credit appraisals, carrying out more precise comprehensive public credit appraisals on the foundation of the national appraisal results and enriched through local and designated industry credit data. Vigorously support relevant national and local departments for industry regulation in carrying out industry credit appraisals. Industry credit appraisal and market credit appraisal results should be considered in carrying out comprehensive local public credit appraisals. In the course of implementing hierarchic and categorical regulation, the results of national and local level comprehensive public credit appraisals, industry credit appraisals,and market credit appraisals should be organically combined, and used as a whole.

V. Encourage Third-party Credit Service Establishments to Carry out Market Credit Appraisal

All levels of department leading the establishment of the social credit system should forcefully cultivate the development of the credit services industry, actively creating conditions to support third-party credit service establishments in carrying out multiple forms of market credit appraisals, using big data to create precise 'credit pictures'; providing credit services to market activities such as financial lending, bidding and tendering, and commercial cooperation; and satisfying the market's ever increasing demand for credit services. Encourage relevant departments of local governments to use methods such as government procurement to bring third-party credit service establishments' participation into comprehensive public credit appraisal.

VI. Lead Market Entities to to Strengthen the Establishment of Credit, Guided by the Comprehensive Public Credit Appraisals

All levels of department leading the establishment of the social credit system are to make full use of comprehensive public credit appraisals, using the opportunity to lead and push all types of market entities in strengthening their credit establishment. Lead market entities with appraisal outcomes of 'exceptional' or 'good' to further improve their credit records, solidifying or increasing their credit level, and continuously increasing their reputation and competitiveness. Reminder meetings and special trainings should be organized in an appropriate manner for market entities with appraisal outcomes of 'average' to lead them to pay attention to credit management, indicating directions for improvement, and optimizing their credit state. For market entities with appraisal outcomes of 'poor', follow the principle of local management to have the local municipal or county departments leading the establishment of the social credit system, in conjunction with competent departments for the industry, to give talkings to their responsible parties, and inform them in person of the appraisal outcome, the main untrustworthy conduct, channels for credit restoration and so forth; urging and assisting them in immediately making corrections, and concurrently include the record of the talks (including situations such as refusal to talk or not cooperating) in their credit records, and including this in the national credit information sharing platform.

All levels of department leading the establishment of the social credit system are to strengthen overall planning and coordination, cooperate closely with the regulatory departments for relevant industries, and fully use the results of comprehensive public credit appraisals, truly strengthening credit management. Each provincial department leading the establishment of the social credit system is requested to promptly give feedback to the finance department of our Commission and the National Public Credit Information Center on issues and problems encountered in the work, as well as relevant experiences, methods, and model cases.
