Article 1: The following measures are drafted on the basis of relevant laws and regulations together with the actual conditions of our city so as to deepen the construction of a social credit system in our city, to establish a policy direction and benefits mechanisms for praising the creditworthy and punishing the untrustworthy, creating a positive social credit environment, and promoting economic and social development.
Article 2: These Measures apply to the personal credit incentives and punishments, and their management, within the administrative region of this city. Where laws, regulations, and or rules provide differently, follow those provisions.
Article 3: These measures apply to individuals that have lived in Rongcheng for 1 year or more, are 18 years-old or older, who participate in civil activities, enjoy civil rights, and bear civil duties, including the non-local population.
Article 4: "Personal Credit" as used in these Measures refers to the credit level reflecting the personal credit status in accordance with the city's provisions on credit reporting management.
Personal credit levels are dynamically adjusted in accordance with credit records and credit points.
Article 5: Personal credit is divided into 4 grades, A, B, C, and D; with A grades further divided into three value grades on the basis of credit points and credit records: Levels A, AA, and AAA.
Article 6: Personal credit rewards and punishments adhere to the principles of 'emphasizing rewards with punishments as supplement' and and 'giving warnings before punishments', to give the trustworthy expedited handling, simplified procedures, 'green channels', key support, and other incentive policies; and to increase the force of punishments for the untrustworthy, increase the costs of being dishonest, and gradually form joint credit reward and punishment mechanisms where the trustworthy are facilitated in all things, and the untrustworthy are restricted everywhere.
Article 7: The Municipal theme activity office is responsible for guiding and coordinating the city's joint personal credit rewards and punishments. The Office for the Collection and Management of of Social Credit Information is responsible for the work of aggregating, integrating, and publishing personal credit information; establishing and maintaining the municipal Public Credit Information management system and "Credit Rongcheng" network, and providing all necessary credit information for the implementation of credit rewards and punishments.
Article 8: Every district, town, and neighborhood, and each relevant departments may draft detailed implementation rules and accompanying systems for rewarding trustworthiness and punishing untrustworthiness, fully improving credit reward and punishment mechanisms.
Article 9: When relevant departments carry out economic regulation, market oversight, social management, public services, and other such functions, they should take the lead in using credit assessment outcomes, and carry out categorical credit management.
Article 10: Individuals enjoy legal rights as provided by laws and regulations such as the right to know, contest, and object to credit information and credit levels involving them.
Article 11: Where individuals have "A" level credit, the following measures are employed as incentives:
(1) Entry onto the municipal level or industry creditworthiness 'red list', and be used as a model of creditworthiness in external publicity or recomendations;
(2) Get priority care in school enrollment, basic living allowance, social assistance, and other areas;
(3) Get preferential care in employment, social assistance, arrangement and allocation of subsidies, and other such areas; and given added points in qualifications assessments and other such works;
(4) Given preferential recommendations in recruiting Party members, award selections, qualification assessments, hiring for positions, professional title assessment, and other such activities; and add points in award selections or evaluation activities.
(5) Given priority support in policies, lending, and funding for personal entrepreneurship and creating an enterprise;
(6) Reducing or waiving normal oversight inspections;
(7) Priority recommendation when seeking grants, subsidized loans, production support funds, and other supports;
(8) Priority consideration or added points when participating in selection for government investment project bidding, government procurement, as well as government procurement of services;
(9) Priority recommendation in applying for all kinds of scientific projects;
(10) Establish 'windows for the creditworthy' in municipal government service center lobbies to provide ongoing coordination or completion of formalities on their behalf, to bring about priority handling, simplified procedures, and other 'green channel' support incentive policies;
(11) Free occupational skills and entrepreneurship training;
(12) Where staff of state organs or public institutions have the requirements for selection and appointment, give them preference in promotion and reuse work procedures;
(13) Joint reward measures carried out by relevant department, as well as other incentive measures.
Article 12: Residents with "AA" or AAA" level credit for an annual period ,other than state employees, enjoy the following incentive measures in addition to the policies and benefits provided for in article 11.
(1) Given a 200 RMB subsidy when paying into residents basic pension insurance;
(2) Given a 100 RMB subsidy when paying into residents basic medical insurance;
(3) Residents who are participants in the insurance system who receive residential medical care are given a 5% subsidy on top of the basic reimbursement standard ratio;
(4) Residents under 64 years of age are given a 100 RMB public transportation subsidy, and seniors 65 years and older do not have annual accident insurance fees collected;
(5) Village residents under 60 years old are given one free health check;
(6) Those who have lawfully registered with the city's market supervision and management departments, engaging in low-profit projects, may apply for interest free subsidized loans of 100,000 RMB, for periods not exceeding 2 years;
(7) On urban and rural commercial bank loans that meet lending requirements, may enjoy a three percentage point benefit on current implementation rates;
(8) Other reward measures on a 'one per matter' basis.
Article 13: For individuals with B level Credit, relevant departments shall employ methods such as credit reminders, having talks about creditworthiness, and having credit reviews, to increase management; conduct publicity and education on relevant laws, regulations, and policies at appropriate times; and selectively provide incentive measures provided for in article 11 of these measures where a change in credit assessments is seen.
Article 14: For natural persons with C level credit, employ the following penalty penalties:
(1) Make them key subjects of routine oversight and management;
(2) Conduct public notices that are limited in scope, and written notice;
(3) temporarily suspend or reduce other relevant social welfare, subsidies, and preferential government policies;
(4) cancel qualifications for awards selection;
(5) Cancel credentials for participation in government led procurement or bidding;
(6) Prohibit registering for testing to become a municipal administrative affairs or public interest post employee;
(7) Joint disciplinary action implementated by relevant departments, as well as other management measures lawfully employed in light of the circumstances;
Article 15: For natural persons with D-level credit, employ the following penalty penalties:
(1) Make them the target of key monitoring and oversight inspections;
(2) Cancel government funding supports and subsidies;
(3) Enter them in the 'blacklist' publicly disclosing the information on their untrustworthiness;
(4) Revoke relevant honorific titles, and prohibit participation in award selection;
(5) Prohibit registering for testing to become a municipal administrative affairs or public interest post employee;
(6) Suspend or cancel professional qualifications related to the untrustworthy conduct;
(7) Cancel eligibility to participate in government led procurement and bidding;
(8) Restrict loans;
(9) Strict joint disciplinary action implemented by relevant departments, as well as other management measures lawfully employed in light of the circumstances;
Article 16: Credit management of state employees is to concurrently apply the provisions of the "Rongcheng City Provisional Measures for Rewarding Trustworthiness and Punishing Untrustworthiness of State Organ and Public Institution Personnel" (RongZuFa (2016) No.6).
Article 17: Credit management of leaders and the cadre team of state organs and public institutions, the cadre team and Party members of villages' basic level organizations and, as well as all levels of '2 represents and 1 committee' [party representatives, people's congresses, and politcal consultative committee] members concurrently apply the relevant provisions of the "Opinions on Strengthening the use of Credit Appraisal Outcomes in Management of Party Cadres and '2 represents and 1 committee' Members Throughout the City" (Rongbanfa (2014) No.21.
Article 18: All levels of competition and selection activity for the whole city; higher-level selection, declarations, and recommendations of advanced models; concurrently apply the relevant provisions of the 'Opinions on the Use of Credit Appraisal Outcomes in Competitions throughout the City' (Rongchengfa (2015) No.16).
Article 19: Relevant functional departments shall strengthen credit management of key professional groups, and may lawfully employ the following punishment methods in addition to the other punishment methods provided for in these Measures:
(1) For technical professionals or others who are required to obtain professional qualifications in accordance with law, the relevant functional departments may lawfully revoke their professional technical qualifications or practice credentials, and prohibit them from applying for professional technical qualifications or practice credentials again;
(2) For legal representatives and responsible parties of legal persons, beneficial policy supports and financial subsidies may be revoked or reduced for the legal person, and prohibit participation government procurement activities; when relevant functional departments organize bidding, they may restrict or revoke legal persons' qualifications to participate in the bidding.
(3) Cancel qualifications to participate in all competitions;
(4) Cancel qualifications for all kinds of accreditation, and oversight examination;
(5) Other punishment methods stipulated by laws, regulations, and rules.
Article 20: Credit subjects with C-level credit are entered into the municipal public joint credit reporting system yellow list for 2 years.
Credit subjects with D-level credit are entered into the Public Credit Information management system blacklist for 5 years.
Enterprises and individuals shall inquire into the personal blacklists when carrying out credit transactions or other activities, to reduce credit risks.
Article 21: The municipal government is to establish a 'credit fund' to be used for incentives for incentive policies for qualified individuals.
Article 22: Relevant townships and communities are responsible for work on residents case rewards. Relevant departments such as for finance, human resources and social security, health and family planning, transport, government affairs service centers, and rural commercial banks are responsible for paying out on benefit policies, with all necessary costs being disbursed from the 'Credit Fund'.
When individuals with AA or AAA credit levels apply to neighborhoods to enjoy relevant incentive policies, they must provide credit reports appraising them as AA or AAA credit level.
The period for enjoyment of benefit policies is before the end of June of the following year. Where individuals do not apply to enjoy relevant benefit policies during the validity period, the incentive policies are not to be paid on.
Article 23: December 31 of each year is the point where AA and AAA credit level residents enjoy the benefits in article 12.
Article 24: The relevant functional departments are responsible for efforts to punish persons with C and D level credit.
Article 25: The municipal credit reporting management bodies and credit information providers shall establish systems for reports and complaints on untrustworthy conduct, and when receiving complaints and reports from citizens, legal persons, or other organizations are responsible for accepting, investigating, and giving feedback on the reports.
Article 26: Where people's courts or relevant departments lawfully request that joint oversight measures be implemented, the relevant departments shall cooperate.
Article 27: The municipal credit reporting management bodies should establish and improve mechanisms for credit information interconnectivity, strengthening information delivery and communication, and should have set methods for circulating AA, AAA, C, and D levels to relevant departments and communities; and where credit levels have changed during a year, should report this back to the relevant departments at the first possible moment.
Article 28: Relevant administrative organs shall establish a 'blacklist' system for the coresponding industry, clarifying the requirements and procedures for entry and removal from the 'blacklist', and promptly sending the 'blacklist' of the untrustworthy to the municipal credit reporting management bodies, to include them in personal credit archives and make them public.
Article 29: Relevant departments and industry associations are to draft self-discipline rules for practitioners, use social media and online resources to strengthen reports on credit behavior, give praise and publicity to the trustworthy, and give internal industry warnings and alerts to the untrustworthy, circulate criticisms, and disclosure and expose and publicly censure.
Article 30: If persons entered into the yellow or black lists have major meritorious performance, outstanding contributions, or special family circumstances that require emergency assistance, their credit levels should be announced to the public with the special reasons that need to be resolved or need assistance, and upon approval from the relevant competent departments, the applicable standards for qualifications determinations, license examinations, or assistance should be relaxed.
Article 31: The municipal credit reporting management body is to investigate and evaluate relevant departments implementation of joint credit reward and punishment efforts, and promptly promote experiences and methods for rewarding trustworthiness and punishing untrustworthiness.
Article 32: Where credit rewards and punishments are adjusted to changes in policy or circumstances, the municipal credit reporting management body is to promptly announce these to the public.
Article 33: Where reward or punishment measures are not carried out in accordance with provisions, the municipal credit reporting management body is to order corrections. Where corrections are refused, the discipline inspection and supervision departments are to give sanctions to the responsible units and directly responsible personnel.
Article 34: Where information providers failure to perform duties to provide personal information, causing parties to not promptly receive corresponding rewards or punishments, the discipline inspection and supervision departments are to give sanctions to the responsible units and directly responsible personnel. Where it causes economic harm to parties, the relevant units should bear the corresponding compensation.
Article 35: These Measures are to take effect from their date of publication.
