Article 1: These Provisions are drafted on the basis of the "People's Republic of China Civil Servants Law" so as to clarify the scope of civil servants, regulate the administration of civil servants, and establish a high-caliber professional civil service corps that is firm in its beliefs, serves the people, is diligent and pragmatic, dares to act and is honest and upright.

Article 2: The determination of the range of civil servants is to persist in the leadership of the Communist Party of China and be guided by Marxism-Leninism, Mao Zedong Thought, Deng Xiaoping Theory, the Theory of the "Three Represents", the Scientific Outlook on Development, and Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, and to implement the organizational line of the Chinese Communist Party for the new era, and persist in the principle of Party management of cadres, to strengthen the Party's unified leadership of the civil service corps, and to reflect the characteristics of China's political system beginning from China's national condition and conforming to the actual conditions of cadre and personnel management.

Article 3: Civil servants are an important part of the corps of cadres, are the central force in socialist affairs, and are the servants of the people.Personnel included in the scope of civil servants must simultaneously meet the following requirements:

(1) Perform public duties in accordance with law;

(2) Be included in the national administrative personnel deployment;

(3) Have state finance be responsible for their salary and benefits.

Article 4: In addition to staff, other employees at the following organs are also included in the scope of civil servants:

(1) All levels of CCP organs;

(2) All levels of People's Congress and their Standing Committees;

(3) All levels of administrative organs;

(4) Committee organs at all levels of the Chinese People's Political Consultative Conference;

(5) All levels of supervision organ;

(6) All levels of adjudication organ;

(7) All levels of procuratorate organ;

(8) Organs at all levels of all democratic parties and federations of industry and commerce.

Article 5: The personnel of CCP organs are included in the scope of civil servants:

(1) Leaders of Party committees and discipline inspection committees at the central and local levels;

(2) Staff of the working departments, offices and remote offices of Party committees at the central and local levels;

(3) the staff of the central and local discipline inspection committees at all levels and their offices that are stationed or dispatched in Party and state organs, etc.;

(4) Staff of street, village, or township Party committee organs.

Article 6: The personnel of levels of People's Congress and their Standing Committees included in the scope of civil servants;

(1) the leadership of the Standing Committees of People's Congresses at the county level or above, and the chairmen and vice-chairmen of township and town people's congresses;

(2) the staff of the administrative bodies and offices of the standing committees of the people's congresses at the county level or above;

(3) the staff of the offices of special committees of people's congresses at the county level or above;

Article 7: The personnel of administrative organs included in the scope of civil servants:

(1) the leadership of all levels of people's government;

(2) Staff of the working departments, offices and remote offices of people's governments at the county level or above;

(3) Staff of village and township people's government organs;

Article 8: The personnel of levels of committee organs at all levels of the Chinese People's Political Consultative Conference included in the scope of civil servants;

(1) The leadership of committee organs at all levels of the Chinese People's Political Consultative Conference;

(2) Staff of the working bodies of committee organs at all levels of the Chinese People's Political Consultative Conference;

Article 9: The personnel of supervision organs included in the scope of civil servants:

(1) the leadership of State and local supervision commissions;

(2) the staff of state and local supervision commission and their offices that are stationed or dispatched in Party and state organs, etc.;

Article 10: The personnel of adjudication organs included in the scope of civil servants:

(1) Judges and trial support staff at the Supreme People's Court and local people's courts;

(2) Judicial administration personnel at the Supreme People's Court and local people's courts;

Article 11: The personnel of procuratorate organs included in the scope of civil servants:

(1) Procurators and procuratorate support personal at the Supreme People's Procuratorate and local procuratorates;

(2) Judicial administration personnel at the Supreme People's Procuratorate and local procuratorates.

Article 12: The personnel of organs of all levels of all democratic parties and federations of industry and commerce included in the scope of civil servants:

(1) the leadership of the central and local committees at all levels of the revolutionary Committee of the Kuomintang and the staff of its work bodies;

(2) the leadership of the central and local committees at all levels of the Democratic League and the staff of its work bodies;

(3) the leadership of the central and local committees at all levels of the Democratic National Construction Association and the staff of its work bodies;

(4) the leadership of the central and local committees at all levels of the Democratic National Construction Association and the staff of its work bodies;

(5) the leadership of the central and local committees at all levels of the Peasants' and Workers' Democratic Party and the staff of its work bodies;

(6) the leadership of the central and local committees at all levels of the Party for Public Interest and the staff of its work bodies;

(7) the leadership of the central and local committees at all levels of the September 3rd Society and the staff of its work bodies;

(8) the leadership of the central and local committees at all levels of the Taiwan Democratic Self-Government League and the staff of its work bodies;

The leadership of the central and local committees at all levels of the All-China Federation of Industry and Commerce and the staff of its work bodies.

Article 13: Where the units and departments of the following personnel are not among the organs listed in article 4, they are not included in the scope of civil servants:

(1) All levels of CCP congress deputies, committee members, alternate committee members, and discipline inspection committee members;

(2) All levels of people's congress deputies, standing committee deputies, and special committee members;

(3) Standing members and members of committees at all levels of Chinese People's Political Consultative Conference;

(4) Members of the central and local committees, standing committees, and special committees of all democratic parties. Executive Committee members, standing committee members, and special committee members of the All-China Federation of Industry and Commerce and local federation of industry and commerce.

Article 14: Personnel within the scope of civil servants may only be designated as civil servants after being registered in accordance with provisions.

Article 15: The Organization Department of the CPC Central Committee is responsible for the interpretation of these provisions.

Article 16: These Provisions take effect from their date of issue, and Appendix 1 "Provisions on the Scope of Civil Servants" to the April 9, 2006 "Implementation Measures for the "Civil Servants Law of the P.R.C." by the Party Central Commission and State Council is simultaneously revoked.
