China's Action Plan Against Human Trafficking (2013-2020) (hereinafter referred to as the “Action Plan“). is drafted on the basis of relevant international conventions and domestic laws, to effectively prevent and lawfully combat crimes of abducting and trafficking women and children, to actively rescue and appropriately settle victims of trafficking, and to truly protect citizens' lawful rights and interests.
1.Guiding ideology and goals
(1) Guiding Thought.
Raise high the glorious banner of socialism with Chinese characteristics, with Deng Xiaoping Theory, the important thought of Three Represents and the Scientific Outlook on Development as guidance, persist in the work directives of "being people-centered, comprehensive governance, emphasizing prevention, and combining prevention with the struggle' to continuously strengthen and innovate in social management, improve policies, implement responsibility, integrate resources, address symptoms and causes, truly safeguard citizens' basic rights, and preserve social harmony and stability as well as our nation's international image.
(2) Overall Goals
Further improve long-term and effective mechanisms for countering human trafficking that integrate prevention, enforcement, aid, and rehabilitation, complete mechanisms for coordinating and ensuring efforts to combat trafficking, refine and implement every measure, resolutely combat and effectively curb trafficking crimes in accordance with law, ensure that trafficked persons promptly receive aid and rehabilitation and appropriate placements.
II. Operational Measures and Division of Responsibilities
(1) Complete crime prevention mechanisms.
1. Work objectives.
Improve the prevention network for human trafficking crimes and comprehensively punish human trafficking activities in key areas and "buyer's markets", to reduce the occurrences of human trafficking.
2. Action Measures.
(1) Strengthen interdepartmental joint action, establishing work mechanisms for the discovery and reporting of trafficking crimes. (Central Public Security Comprehensive Management Commission and Ministry of Justice are responsible, with the Ministry of Education, Ministry of Public Security, Ministry of Health, and National Population and Family Planning Commission cooperating)
(2) Strengthen efforts to prevent trafficking crimes in key industries and regions for trafficking activities, and among key populations. --Strengthen the management of the human resource market, regulating labor demand, employer recruitment, and intermediary activities, and encouraging employers to carry out education and training on trafficking. Establish and improve the system of labor and employment filing, strengthening investigation and law enforcement for labor safeguards, increasing the force of investigation and handling for violations such as illegal occupational intermediaries, use of child labor and persons with intellectual disabilities, and improve mechanisms for interdepartmental coordination. Research the issue of trafficking occurring in the labor market, and carry out targeted prevention efforts. -- Strictly combat violations and crimes of prostitution and solicitation, strengthening public security corrections in desakota and 'urban village' entertainment service venues, improving efforts on education and support for women. Basic-level governments and villager(resident) committees are to include the assistance of populations vulnerable to trafficking and prevention of trafficking crimes as key work. -- Increase the force of support for rural populations in young, elderly, or poor areas, carry out channels for entrepreneurship and employment suited to rural areas, increasing poverty alleviation, especially for women. (Poverty Alleviation Office Responsible, with Development and Reform Commission, Ministry of Agriculture, Ministry of Human Resources and Social Security, State Ethnic Affairs Commission, and All-China Women's Federation cooperating)
-- Safeguard the right of all school-aged children and youths to receive 9 years of compulsory education, taking control of student drop outs. (Ministry of Education is responsible with the Communist Youth League Central Committee cooperating)
-- Establish and complete mechanisms for aiding homeless minors, actively using current aid management bodies and welfare bodies to complete placements for homeless minors and abandoned infants, relying on social workers and other professionals to provide services such as psychological counseling, behavioral corrections, technical training, and occupational support. Strengthen aid on the streets, promptly discovering and aiding minors who are homeless and begging or who have been coerced to violate laws and commit crimes. (3) Increase the force of corrections for 'buyers markets' for trafficking crimes, carrying out comprehensive governance in areas where the purchase of persons occurs more regularly, to reduce trafficking at its source. --Carry out revisions of villagers' conventions and training on maintaining women's rights and interests and on promoting the equality of the sexes, eliminate backward ideas such as male superiority and seeking a male heir, increase the education level for girls, ensure that females enjoy equal rights in village land contracting, homestead distributions, distribution of land requisition compensation, and collective income distribution. (4) Further complete efforts on transnational trafficking crimes. Strengthen inspections at ports and management of border crossings, making systems for inspecting persons crossing borders more strict, increasing the extent of inspections for foreigners illegally entering, residing, or working in the nation. Strengthen oversight of the human resources market in border areas, strictly regulating cooperative business activities for foreign labor, lawfully shut down illegal international marriage matchmaking establishments. (2) Fight crime and rescue victims of trafficking.
1. Work objectives.
Continuously increase the capacity and level for investigation of trafficking cases, combat trafficking crimes in strict accordance with law, and promptly aid the victims of trafficking.
2. Action Measures.
(1) Continue to organize and carry out special actions on combatting trafficking crimes throughout the nation, further improve counter-trafficking mechanisms in which the public security organs lead the way, relevant departments assist, and the public widely participates. (The Ministry of Public Security is responsible, with the Supreme People's Court, The Supreme People's Procuratorate, Ministry of Civil Affairs, Ministry of Human Resources and Social Security, Population and Family Planning Commission, and All-China Women's Federation cooperating.
-- The relevant departments and units of each level of government are to increase the force of counter-trafficking efforts, clarify the specific burdens of relevant bodies, ensure that there are persons responsible and persons to complete the work, and enhance funding safeguards. After a report of a missing child is received, the public security organs command center is to rapidly consolidate police forces to carry out efforts to intercept and locate them, promptly capturing criminal suspects, and freeing victims. Where children are adopted or children whose identities are unknown are settled, a blood test is to be made and entered and compared with the database, as a strict requirement for the settlement of children. (2i)Strictly punish human trafficking in accordance with law。
-- Resolutely and lawfully punish those with circumstances calling for heavier sentences, such as the leaders of trafficking groups, or those who participated multiple times, trafficked multiple people, and committed other violations and crimes while trafficking, or recidivists. -- Resolutely and lawfully punish those who purchase victims of trafficking and use violence, threats, or assembling a crowd to obstruct employees of state institutions in aiding the victim, and who shall be pursued for criminal responsibility in accordance with law. -- Strictly pursue the administrative, civil, and criminal responsibility of units and individuals who buy, act as an intermediary, or compel trafficked persons to engage in sexual services or forced labor. Resolutely shut down illegal employment and marriage intermediaries. Lawfully punish those who compel children or persons with disabilities to beg or engage in illegal or criminal activities, promptly locating the victims' families and escorting victims to aid and protection establishments. Improve organ donation systems, giving punishments in accordance with law to those who commit crimes such as stealing organs, tricking or compelling others to donate organs, or organizing the sale of human organs. (3) Further strengthen the establishment of information networks, improve the national DNA (deoxyribonucleic acid) database for combatting trafficking, complete mechanisms for collecting and exchanging information, advance information sharing, and increase the level of information technology used in combatting trafficking. (The Ministry of Public Security and Ministry of Civil Affairs are responsible, with the Development and Reform Commission, Ministry of Finance, Ministry of Education, Ministry of Health, Population and Family Planning Commission, and All-China Women's Federation cooperating)
(4) Rescue trafficked children in accordance with law, and return them to their birth parents. Where the birth parents cannot be located, the public security organs are to provide relevant materials to the civil affairs departments to make an appropriate placement; families that purchased the children must not continue to raise them. (3) Strengthen efforts to rescue, place, and rehabilitate trafficked persons and for having them reenter society.

Safeguard the lawful rights and interests of trafficked persons, strengthen efforts such as to rescue, place, and rehabilitate trafficked persons and integrate them into families and communities, and assist them in smoothly reentering society. Protect the privacy of trafficked persons so that they avoid having a second harm.
2. Action Measures.
(1) Further strengthen coordination and cooperation on aiding trafficked persons between regions, departments, and institutions. (The Ministry of Civil Affairs is responsible, with the Central Public Security Comprehensive Management Commission, and Ministry of Public Security cooperating)
(2) Regulate procedures for efforts on the rescue, placement, rehabilitation, and re-entry of trafficked persons, draft policies and measures on placing trafficked children whose birth parents cannot be found, promote their return to their families and their healthy growth. (3) Improve mechanisms for the rescue, placement, and rehabilitation of trafficked persons in which multiple government departments cooperate and that are supported by all aspects of society, increasing the level of services at aid management stations, women's homes, welfare institutions, and other such institutions. (1) Revise relevant laws and regulations to further complete the legal system for countering trafficking. 1. Work objectives.
Strengthen recognition of the importance of human trafficking in all levels of government and their relevant departments, and all parts of society, mobilizing broad participation in combatting trafficking from the whole of society. Strengthen education, training, and theoretical research to increase capacity for combatting trafficking.
2. Action Measures.
(1) Carry out publicity and education through multiple channels and in multiple forms, emphasizing carrying out counter-trafficking education and rule of law publicity in key areas for trafficking and among vulnerable populations, enhancing the public's awareness of countering tracking. Effectively prevent and strictly combat transnational trafficking, and strengthen rescue of persons trafficked across borders. Actively participate in discussions and consultations with the international community on issues related to combatting trafficking, presenting the methods and accomplishments of our nation in countering trafficking, establishing a positive international image.
2. Action Measures.
(1) Strengthen international exchanges and cooperation on countering trafficking. (Ministry of Foreign Affairs and Ministry of Public Security are responsible, with the Ministry of Commerce cooperating)
(2) Make full use of resources and technology from relevant international organizations and strengthen the establishment of international counter-trafficking programs and introduction work. (The Ministry of Public Security is responsible, with the Ministry of Foreign Affairs and Ministry of Commerce cooperating)
-- Actively participate in all international counter-trafficking mechanisms such as the Greater Mekong Subregion COMMIT process. (The Ministry of Public Security is responsible, with the Legal Affairs Commission of the Standing Committee of the National People's Congress, the Supreme People's Court, The Supreme People's Procuratorate, Ministry of Foreign Affairs, Ministry of Civil Affairs, Ministry of Human Resources and Social Security, Ministry of Commerce, Working Committees on Children and Women, and All-China Women's Federation cooperating)
-- Strengthen exchanges and cooperation with international immigration organizations, the United Nations Children's Fund, the UN Office on Drugs and Crime, and other international organizations and nations, to jointly carry out counter-trafficking training, learn of developing trends in international trafficking and response measures, and present out nation's achievements in countering trafficking. (The Ministry of Foreign Affairs, Ministry of Public Security and Ministry of Commerce are responsible with the All-China Women's Federation cooperating)
(3) Strengthen cooperation in international policing, making full use of channels such as bilateral, multilateral, and international criminal policing organizations, carry out investigative cooperation and intelligence information exchanges in countering transnational trafficking, giving play to the role of border police liaison mechanisms, to jointly combat transnational trafficking crimes. (The Ministry of Public Security is responsible, with the Ministry of Foreign Affairs and Ministry of Justice cooperating)
(4) Strengthen cooperation with relevant source countries and international organizations, promptly rescuing and receiving Chinese nationals that were trafficked abroad, and provide them with necessary services. (Ministry of Foreign Affairs and Ministry of Public Security are responsible, with the Ministry of Civil Affairs cooperating)
(5) Strengthen cooperation with relevant source countries for trafficking and international organizations, to promptly discover and rescue persons trafficked to China, improve mechanisms for efforts to rescue victims of transnational trafficking, complete efforts on transition and rehabilitation, and safely repatriate them. (Ministry of Foreign Affairs, Ministry of Public Security, Development and Reform Commission are responsible, with the Ministry of Civil Affairs cooperating)
(6) Earnestly perform and make full use of the United Nations Convention against Transnational Organized Crime and its supplemental Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children, and steadily advance the conclusion of judicial assistance and extradition treaties with other countries, particularly neighboring countries, to further expand the international network of judicial cooperation to combat trafficking. (The Ministry of Foreign Affairs is responsible, with the Supreme People's Court, Supreme People's Procuratorate, Ministry of Public Security, and Ministry of Justice cooperating)
III. Safeguard Measures
(1) Strengthen Organizational Coordination. The Inter-ministerial Joint Conference of the State Council on Countering Trafficking is to strengthen organizational leadership and overall coordination, formulate and improve policy measures, and promptly study and resolve outstanding problems and challenges. The general office of the inter-ministerial joint conference is responsible for coordinating and organizing oversight and inspections of the implementation of the Action Plan, carrying out periodic and final assessments, and establishing a supervisor and warning system for key cases and areas for countering trafficking. Local governments at the county level or above should gradually establish coordination mechanisms to organize and coordinate, guide and inspect counter-trafficking work, and draft local detailed implementation rules for the Action Plan and annual implementation plans. Member units of all levels of counter-trafficking mechanisms at all levels should closely cooperate, draft implementation plans for that department or unit on the basis of the tasks and division of labor, and carry out self-inspections and assessments.
(2) Improve safeguards for expenses. All levels of government are to include costs for implementation of the Action Plan in their budgets. Encourage social organizations, public interest bodies, enterprises, public institutions, and individuals to raise money through various channels such as donations and international aid.
(3) Strictly evaluate and oversee. Include counter-trafficking in social management and comprehensive governance evaluations and in the target management and evaluation system for relevant departments and institutions, sending evaluation results to the departments in charge of cadres to be an important basis for the comprehensive evaluation and assessment of leadership and leading cadres. Commendations and awards are to be given to departments and regions with effective measures and notable accomplishments in countering trafficking. The responsibility of relevant personnel is to be pursued in accordance with laws and discipline in areas where trafficking crimes is serious and the efforts to prevent and combat it are inadequate, and totally rejected in social management and comprehensive governance
