Chapter I: General Provisions

Article 1: These Regulations are formulated on the basis of the Charter of the Communist Party of China, so as to further regulate the work of party groups, strengthen and improve Party leadership, raise the Party's capacity to govern, and better bring into play the Party's core leadership functions in taking charge of the big picture and coordinating all aspects.

Article 2: Party groups are the Party's leading institutions established in Central and local state organs, people's organizations, economic organizations, cultural organizations, social organizations and other organizations leadership organs, to serve a core leadership funcion in those units.

Article 3: Party group work shall abide by the following principles:

(1) Persist in the Party's leadership and ensure that the Party's theory and path policies and directives are put into place and carried out;

(2) Persist in comprehensive and strict Party governance, carrying out work on the basis of the Party Charter and other internal Party Laws and regulations, putting into place a system of Party groups managing Party governance and Party responsibility;

(3) Persist in a system of democratic centralism,ensuring the vitality of Party groups and the unity and solidarity of the Party;

(4) Persist in having Party groups bring into play core leadership functions and performing duties together uniformly with a unit's leadership in accordance with law,making the Party's propositions become the unit leaderships' decisions through legally prescribed democratic procedures.

Article 4: Party groups must submit to the leadership of the Party organization that approved their establishment. The Party's Central Committee and local committees shall strengthen leadership of Party groups' work. Party organization departments are responsible for review and approval of the establishment of Party groups, daily management and other specific work; discipline inspection organs and other Party committee work departments and relevant remote offices divide and perform relevant work on the basis of their duties.

Chapter II: Establishment

Article 5: Where the leadership organs of central and local state organs, people's organizations, economic organizations, cultural organizations, social organizations and other organizations, have 3 or more Party members as leading members, a Party group may be established upon apporoval.

People's Congress standing committees, governments and their departments, political consultative conferences, courts and procuratorates at the county level or above, and people's organizations such as labor unions and Women's Federations, shall generally establish Party groups. Organs of People's Congress standing committees, government organs, and political consultative conferences organs at the county level or above may establish Party groups upon approval of the Party Committee at theat level.

Public institutions directly under people's governments at the county level or above may establish Party groups, except for those that shall establish Party organizations in accorance with rules.

Vitally important state-owned key enterprises and vital financial enterprises may establish Party groups upon approval of the Party's Central Committee, except that those directly under its control generally no longer establish Party groups.

Nationally important cultural organizations and social organizations may establish Party groups upon approval of the Party's Central Committee.

Organizations other than those described and provided for above may establish Party groups as work requires, upon approval.

Article 6: The establishment of Party groups shall generally be reviewed and approved by the Party Central Committee or local committees. Party groups must not review and approve the establishment of Party groups.

Where relevant organizations that have already established Party groups truly need to establish a Party groups in a unit below them due to industry or system management needs, the Party groups will report to the party committee organizational department at that level for review and approval.

新成立的有关组织符合设立党组条件的,党的中央委员会或者本级党的地方委员会可以根据需要作出设立党组的决定,也可以由需要设立党组的单位或者其上级主管部门提出设立申请,由党的中央委员会或者本级党的地方委员会决定。

有关组织因机构改革、部门职能变化、区划调整等原因需要变更、撤销党组的,由批准其设立的党组织及时作出决定。

Article 7: A Party group shall have a secretary and, if necessary, deputy secretaries.

党组书记一般由本单位领导班子主要负责人担任,主要负责人不是中共党员或者由上级领导兼任以及因其他情况不宜担任党组书记的,党组书记、主要负责人可以分设。其他党组成员一般由本单位领导班子成员中的党员干部和纪检组组长担任,必要时也可以由本单位重要职能部门或者下属单位党员主要负责人担任。

国有企业党组书记根据企业内部治理结构形式确定,建立董事会的一般由董事长兼任,未建立董事会的一般与总经理分设。其他党组成员一般由进入董事会、监事会、经理层的党员领导人员和纪检组组长根据工作需要担任。

党组成员一般设3至7人,省部级以上单位、中管国有重要骨干企业和中管金融企业党组成员一般不超过9人。

Article 8: 党组成员除应当具备党章和《党政领导干部选拔任用工作条例》规定的党员领导干部的基本条件外,还应当有3年以上党龄,其中厅局级以上单位的党组成员应当有5年以上党龄。

党组成员一般由批准设立党组的党组织决定。实行垂直管理或者实行双重领导的单位设立党组的,其下级单位党组成员的任免按照干部管理权限执行。分党组成员由其上级单位党组决定。企业党组成员的任免,按照干部管理权限执行。

Chapter III: Responsibilities

Article 9: Party groups shall earnestly perform political leadership responsibilities and efforts for theoretical arming and ideological governance; responsible for studying, publicizing, carrying out and enforceing the Party's theory and path, policies and directives; for putting into place and carrying out the Party Center and higher level Party organizations decisions and deployments; and for bringing into play the important function of putting the orientation and overall picture into practice.

Article 10: Party groups deliberate on decide upon the major issues listed below in their unit:

(1) Important matters that need to be reported to the Party organization at a higher level for instruction, and important matters that lower level units' Party groups, organs or directly controlled units' Party Organizations report asking for instruction;

(2) Matters such as internal organizational structuring, responsibilities and staffing allotments;

(3) Matters on major decision-making, important staff appointments and dismissals, major project planning, and use of large sums of capital;

(4) Important matters in the area of establishment of basic-level Party organizations and party member corps;

(5) Important matters in the areas of awareness raising, ideological governance, and the establishment of spiritual culure;

(6) Important matters in the areas of clean governance and party integrity and anti-corruption efforts;

(7) Other important issues that should be deliberated and decided upon by the Party groups.

Article 11: 党组应当贯彻党管干部原则,按照信念坚定、为民服务、勤政务实、敢于担当、清正廉洁的好干部标准,加强干部队伍建设,完善干部培养选拔机制,加强干部教育培训,从严管理监督干部。

党组应当贯彻党管人才原则,按照党中央和上级党组织关于人才工作重要决策部署,加强人才队伍建设。

Article 12: 党组应当加强对本单位统战工作和工会、共青团、妇联等群团工作的领导,重视对党外干部、人才的培养使用,更好团结带领党外干部和群众,凝聚各方面智慧力量,完成党中央和上级党组织交给的任务。

Article 13: 党组应当认真履行党要管党、从严治党责任,加强对本单位党的建设的领导,落实党建工作责任制。党组书记应当履行抓党建第一责任人的职责,其他党组成员根据分工抓好职责范围内党的建设工作。

党组应当加强对本机关和直属单位党组织工作的指导,支持党的机关工作委员会履行对机关和直属单位党组织工作的领导职责。

党组应当认真履行党风廉政建设主体责任,支持纪检监察机构履行监督责任。

Article 14: 党组及其成员应当加强思想政治建设,坚定理想信念,严守政治纪律和政治规矩。严肃党内政治生活,按照规定召开民主生活会,开展严肃认真的批评和自我批评。严格落实中央关于改进工作作风、密切联系群众的各项规定,坚决反对形式主义、官僚主义、享乐主义和奢靡之风。切实增强践行“三严三实”要求的思想自觉和行动自觉。严格遵守党员领导干部廉洁从政有关规定,自觉接受党组织和党员群众的监督。

Article 15: 实行垂直管理或者实行双重领导并以上级单位领导为主的单位党组,可以讨论决定本系统工作规划部署、机构设置、干部队伍管理、党风廉政建设等重要事项。

下属单位设立分党组的单位党组,可以领导分党组的工作。

国有企业党组讨论和决定重大事项时,应当与公司法、企业国有资产法等法律法规相一致,并与公司章程相衔接。经营管理方面事项一般按照企业内部治理结构由董事会或者经理层决定,涉及国家宏观调控、国家发展战略、国家安全等重大经营管理事项应当经党组研究讨论后由董事会或者经理层作出决定。

Article 16: 县级以上人大常委会机关党组、政府机关党组、政协机关党组,必须服从批准其设立的党组织领导,在履行职责过程中还应当接受本级人大常委会党组、政府党组、政协党组的领导。

实行垂直管理或者实行双重领导的单位党组,在履行职责过程中,除接受批准其设立的党组织领导外,还应当向本系统上级单位党组或者本级地方党委请示报告党的工作。

Article 17: 党组书记主持党组全面工作,负责召集和主持党组会议,组织党组活动,签发党组文件。

党组副书记协助党组书记工作,受党组书记委托履行相关职责。

党组书记空缺时,上级党组织可以指定党组副书记或者其他党组成员主持党组日常工作。

党组成员根据党组决定,按照授权负责有关工作,行使相关职权。

Chapter IV: Organization Principles

Article 18: 党组必须坚决执行党中央和上级党组织的指示和决定,坚决维护党中央权威,确保中央政令畅通。

Article 19: 建立健全党组向批准其设立的党组织请示报告工作制度。党组每年至少作1次全面报告,遇有重大问题应当及时请示报告。

执行党中央和上级党组织以及上级单位党组某项重要指示和决定的情况,应当进行专题报告。

Article 20: 党组对有关重要问题作出决定时,应当根据需要充分征求机关和直属单位党组织及本单位党员群众的意见。重要情况应当及时进行通报。

Article 21: 党组实行集体领导制度。凡属党组职责范围内的事项,应当按照少数服从多数原则,由党组成员集体讨论决定。

党组书记应当带头执行民主集中制,不得凌驾于组织之上,不得独断专行。党组成员应当认真执行党组集体决定,勇于担当、敢于负责,切实履行职责。

Article 22: 以党组名义发布或者上报的文件、发表的文章,党组成员代表党组的讲话和报告,应当事先经党组集体讨论或者传批审定。党组成员署名发表的与工作有关的文章,应当事先经党组审定或者经党组书记批准。

党组成员在调查研究、检查指导工作或者参加其他活动时发表的个人意见,应当符合党组决定精神。

Chapter V: Deliberation and Decision Making

Article 23: 党组议事决策应当坚持集体领导、民主集中、个别酝酿、会议决定,重大决策应当充分协商,实行科学决策、民主决策、依法决策。

党组应当结合本单位实际,在其工作规则中明确议事内容目录,实行清单管理。议事内容目录可以根据工作需要适时进行调整。

Article 24: 党组作出重大决策,一般应当在调查研究基础上提出方案,充分听取各方面意见,进行风险评估和合法合规性审查,经过集体讨论决定。

党组讨论决定人事任免事项,应当严格按照《党政领导干部选拔任用工作条例》执行。

Article 25: 党组议事决策一般采用党组会议形式。党组会议一般每月召开1次,遇有重要情况可以随时召开。

党组会议议题由党组书记提出,或者由其他党组成员提出建议、党组书记综合考虑后确定。

Article 26: 党组会议应当有半数以上党组成员到会方可召开,讨论决定干部任免事项必须有三分之二以上党组成员到会。党组成员因故不能参加会议的应当在会前请假,对会议议题的重要意见可以用书面形式表达。党组会议议题涉及本人或者其亲属以及存在其他需要回避情形的,有关党组成员应当回避。

根据工作需要,召开党组会议可以请不是党组成员的本单位领导班子成员列席。会议召集人可以根据议题指定有关人员列席会议。批准其设立的党组织可以派员列席党组会议。

Article 27: 党组会议议题提交表决前,应当进行充分讨论。

表决可以采用口头、举手、无记名投票或者记名投票等方式进行,赞成票超过应到会党组成员半数为通过。未到会党组成员的书面意见不得计入票数。表决实行主持人末位表态制。会议研究决定多个事项的,应当逐项进行表决。

党组会议由专门人员如实记录,并按照规定存档备查。

Article 28: 党组决策一经作出,应当坚决执行。党组成员对党组决策有不同意见的,可以保留或者向上级党组织反映,但在党组决策改变前应当坚决执行。党组应当建立有效的督查和反馈机制,确保党组决策落实。

Chapter VI: Pursuit of Accountability

Article 29: 建立党组书记述职制度。批准设立党组的党组织根据需要可以听取党组书记报告履职情况。

建立党组及其成员履职考核制度,由批准设立党组的党组织负责,纪律检查机关、党委有关工作部门、党的机关工作委员会参与。考核应当每年开展1次,可以与党组工作报告和领导班子年度考核、民主生活会结合开展。

党组及其成员执行本条例情况,应当自觉接受纪律检查机关及其派驻机构、本单位基层党组织和党员群众的监督,纳入巡视监督范围和党员定期评议内容。

Article 30: In any of the following circumstances, the responsibility of the Party member(s) concerned should be pursued

(一)Untimely and inefficiently implementing the Party line and Party policy as directed by superior [ranked] Party members;

(二)Causing evil influences or major harm as a result of violating procedures for policy decisions or policy decisions themselves;

(三)Major problems emerge in high achieving cadre appointments;

(四)Not conscientiously implementing rigorous control over Party responsibilities, causing one's unit's Party organisation to become enfeebled and Party-building work to slacken off;

(五)Failing to implement primary responsibilities for Party discipline and clean governance construction, causing grave consequences;

(六)Publicly and without permission issuing or publishing speeches, reports, articles or other written works that do not conform with the spirit of the Party Centre or the decisions of Party groups, or speaking online in a manner that does not conform with the spirit of the Party Centre or the decisions of Party groups

(七)leaking the contents of meetings or the circumstances of discussions where those should be kept confidential/secret;

(八)where they are responsible for others' actions which have grave consequences or harmful/evil influences on society;

对发生集体违反本条例行为的,或者在其他党组成员出现严重违反本条例行为上存在重大过失的,还应当追究党组书记的相关责任。

党组重大决策失误的,对参与决策的党组成员实行终身责任追究。

党组成员在讨论决定有关事项时,对重大失误决策明确持不赞成态度或者保留意见的,应当免除或者减轻责任。

Article 31: 对违反本条例的党组成员,根据情节轻重,给予批评教育、责令作出检查、诫勉谈话、通报批评或者调离岗位、责令辞职、免职、降职等处理。

应当追究党纪政纪责任的,依照《中国共产党纪律处分条例》、《行政机关公务员处分条例》等有关规定给予相应的党纪政纪处分。

涉嫌违法犯罪的,按照国家有关法律规定处理。

Chapter VII: Party Committees of State Work Departments

Article 32: 本章所称国家工作部门党委,是指根据党章第四十八条规定,党在对下属单位实行集中统一领导的国家工作部门中设立的领导机构,在本部门、本系统发挥领导核心作用。

国家工作部门党委,是党组性质的党委,由上级党组织直接批准设立,不同于由选举产生的党的地方委员会和基层委员会。

Article 33: 在以下国家工作部门和单位中,可以设立党委:

(一)对下属单位实行集中统一领导的国家工作部门;

(二)根据中央授权对有关单位实行集中统一领导的国家工作部门;

(三)金融监管机构;

(四)根据工作需要可以设立党委的其他单位。

党委的设立和撤销,一般应当由党的中央委员会或者本级党的地方委员会审批。实行垂直管理的国家工作部门和单位的党委,负责审批下属单位党委的设立和撤销。

党委根据需要可以设立工作机构,负责党委日常工作。

Article 34: 党委除履行本条例第三章规定的党组相关职责外,还领导本部门机关和直属单位党组织的工作,领导或者指导本系统党组织的工作,讨论决定下属单位工作规划部署、机构设置、干部队伍管理、党风廉政建设等重要事项。

Article 35: 党委设立和撤销的具体程序、委员配备、组织原则、议事决策和责任追究等有关事宜,按照本条例关于党组工作有关规定执行。

Chapter VIII: Supplemental Provisions

Article 36: 各省、自治区、直辖市党委,可以根据本条例,结合实际制定实施细则。

党组(党委)应当根据本条例,结合各自实际制定和完善工作规则。

Article 37: 党组(党委)制定的工作规则等规范性文件,应当参照《中国共产党党内法规和规范性文件备案规定》,报送批准其设立的党组织备案。

Article 38: This Regulation is interpreted by the General Office of the CPC Central Committee in consultation with the Organization Department of the CPC Central Committee.

Article 39: This Regulation enters into force on June 11, 2015. Where other provisions regarding Party groups (Party Committees) are inconsistent with these Regulations, act in accrodance with these Regulations.
